Trump causes Beltway Republicans to go crazy

Trump has to answer to no one, but the people of America

It has been a good week for Donald Trump. He continues to lead in the national polls and has regained the lead in Iowa. The media continues to obsess about everything Trump; his statements, his campaign and his rallies. Crowds were massive for Trump this week in Iowa, Oklahoma and Nevada.

This week, he received a coveted endorsement from former Alaska Governor Sarah Palin, a Tea Party darling. This will undoubtedly help him in Iowa, South Carolina and other states. He was also endorsed by the “Duck Commander,” Willie Robertson, who said that Trump was a “real leader” who epitomized “success and strength.” As usual, he was also interviewed on numerous TV programs touting his campaign success.

I really do not care what you or anyone have to say about the candidates or their positions. Your comment was okay. I am just opposed to personal attacks against other Freepers because of their positions. People should say anything one believes about candidates and positions.

“But the ‘birther’ attack prohibits this action.”

Actually it doesn’t.

If indeed Cruz is a NBC, and has it declared so in court as Trump suggested he do, he could be the VP.

The courts cannot do that.

You do understand that, right?

McCain faced the same problem. He didn’t get a ‘court declaration’.

It cannot happen.

Trump cannot pick Cruz for VP because of this attack.

The birther question is not relevant.

Donald said he didn’t really know. He also said it looked like Ted was getting it straightened out.

Ted is absolutely eligible by clear USCIS CODE. It’s been posted numerous timees.

The slugfest between Donald and Ted is just primary 8politics. Donald has said numerous, even recently that he really likes Ted.

Donald said in early Dec 2015 when Ted’s poll numbers were low that he and Ted agreed on everything but if Ted’s numbers approached his, then he would “have to declare war on Ted”. So the feud is just for show, just politics.

Stick your head in the sand if you like.

Trumps statements will prevent him from being able to select Cruz.

“The courts cannot do that.”

Actually they can and often do. See link...

Those are all in actual cases. There has to be a legal matter first.

The courts cannot take a case where there is not an opponent.

Furthermore, the claim is that the case has to be resolved by the Supreme Court.

Now show where the Supremes would take this issue up and resolve it.

They certainly haven’t done so in the last 8 years for Obama.

There is NO court option.

NONE. ZIP. ZERO. NADA.

Can. Not. Be. Done.

“Additionally, federal courts consider other concerns when analyzing whether to exercise their discretion and hear a request for declaratory relief. A declaratory judgment action may be inappropriate where it is filed to beat the natural plaintiff to the courthouse. This tactic may be intended to deprive the other party of its natural position as plaintiff. Or, it may be intended to deprive the natural plaintiff of its choice of forum. Federal courts sometimes discourage or reject such tactical maneuvers, or “preemptive strike[s]”, as inappropriate uses of the Federal Declaratory Judgment Act. Institute for Studies Abroad Inc. v. Int’l Studies Abroad Inc., 263 F.Supp.2d 1154 (S.D. Ind. 2001). Such a use of the Federal Declaratory Judgment Act “provokes a disorderly race to the courthouse.” State Farm Fire and Casualty Co. v. Taylor, 118 F.R.D 426, 429-30 (M.D.N.C. 1988); see also Fireman’s Ins. Co. of Newark v. Riley, 322 F.Supp. 349, 351 (W.D. Ky. 1971).”

I think Kennedy-Johnson was a similar situation.

That’s a lame response.

When Walker was in the race, Donald pounded on him and called him nasty.

Then, when Walker withdrew, Donald praised him.

That’s Politics 101.

Yes, they can.

An applicant can file a motion for declaratory relief without naming parties. The court can issue a ruling on law with only the applicant.

Again, NO THEY CANNOT..

1) You cannot use the court to immunize yourself from a lawsuit.

2) You have to get the Supremes to hear the case. You are still talking about actions two levels below them.

IT IS NOT POSSIBLE.

McCain didn’t need a court ruling because he had a Senate Resolution.

Apples and Oranges.
