That's a felony, of the 10-years-in-prison variety, and the statute couldn't be clearer.
Hillary Clinton is a felon. There is now no question about that. That doesnât mean sheâs guaranteed to be charged or even convicted, since you still have to allow for the corruption and politicization of the justice system, unfortunately.
But no serious person can argue she is not guilty of a felony after the e-mail the State Department released (with great reluctance, Iâm sure) late last night. In it, she is talking with her then-deputy chief of staff Jake Sullivan, who is supposed to be getting her some talking points about something, and sheâs growing impatient waiting for them. Sullivan explains that whoever has the talking points are trying to send them via secure fax - a sure tip-off that they contain classified information, as thatâs the only reason you would need to send them that way - and that theyâre having trouble with this and are working on the problem.
It does seem like a smoking gun but, honestly, even without that smoking gun, her crimes seem pretty evident to me. Even if the files were labeled secret after she put them on her private server, they were still classified ultimately and, as a result of her decisions, those documents were unsecured and likely made available to foreign intelligence agencies. What difference does it make really if they were classified later? the country was damaged either way. The end result is the crime here, not the manner in which the end result was achieved.
I know you have been following the FBI leaks coming through Joe DiGenova on the investigation. Those leaks are reflecting the commission of over 1000 crimes involving the emails. Very serious violations far beyond what General Petraeous was accused and convicted of. She is in deep trouble. One might predict a presidential pardon but I don’t that obama likes her either. He may order no prosecution if she will step out of the race and the party agrees that Michelle will be Vice President.
My hope is that Hillary will be indicted but I’ll believe it when I see it.
People still believe in the law no matter how many times its been proved to function differently for different classes of people. Whats a crime for you and i is simply a mistake for the exalted ones.

She can be pardoned without even being convicted. No formal court of law was ever convened for Nixon and Ford pardoned him. Obama will pardon her and if not he then if Trump gets in he will. Cruz maybe not. He never socialized with her like Trump did.
One way around this for her, for Obama, is the document in question gets ‘lost’. Can’t prove hat was in it. They’ll get a judge to say inconclusive and throw it out.
While some (usually conservatives) can remain faithful to the Oath they take, they are few and once a person steps across the line to become part of "the club" something dies in their soul. They become protective of the cult and nothing else matters.
This why people like the Clintons can thrive there for decades and all they do is ignored or forgiven - tossed aside for the chance to be close to them, to be associated with their success even knowing that to them nothing and no one matters.
This (I think) is why a Vince Foster can be killed and tossed in the woods and the entire beltway including media rallies in the effort to construct a story of irrelevance. This is why a Sandy Berger can steal and destroy archived documents crucial to a congressional investigation and it's no dig deal.
This is why people across the nation can watch the burning of women and children in Waco Texas and go to work Monday morning as if nothing has happened.
We are all being lulled into submission and numbed to reality.
Another way for her to get around it is to show how many different people she had given her password to, so they could view and send e-mails in her name. This is from her private server, so there is no rule against doing that, in itself. (There likely would be on a government system.)
If it turns out that, say, 15 people had access and none confess or point fingers, the case becomes very difficult to prove.
Couldn't happen to a nicer person.

She believed... and believes... that she can do whatever she wants. She has always been above it all.
She uses the ignorant voters for her purposes, as all democrats do. But, enough voters will have to learn the truth, and actually understand it, before she is put out to pasture.
I doubt that the law will corner her as she is protected in the highest circles. But, maybe, jut maybe some things can’t be protected or hidden anymore. We can hope.

It’s not a matter of classification or of security classification guides. I’ve always been taught in numerous classes going back to the 1970s, that a commander can authorize the transmission of classified information in the clear if that commander deems it necessary to completion of his mission and that the benefits of such a transmission outweigh the costs.
My point was, if a Captain in the Army has this kind of authority, then I’m pretty sure SecState does as well.
I want to add, we were always taught that the authority to transmit in the clear was something that should be used sparingly because you would have to justify such a transmission and you really were in a “you bet your bars” situation. IOW, you damn well better be right.
Though it was speculated (very early on) how the classification stamps were removed from documents from sources like the CIA where the stamps would be mandatory. This is the smoking gun that ties a lot of it together. Hillary said the documents were not marked classified and now we know why, she had the stamps removed.
Basically the classified document transmission systems of the USA have been compromised.
Presumably he complied and sent them nonsecure. Since they are ‘unclassified’ as Hillary will argue, they should be released. If they are classified, then she can be indicted and then the whole matter quashed by Lynch. Two standards for justice now. The rule of law is almost extinct.
There is a procedure for removal of counsel by a Federal Judge for Conflicts of interest and the appointment of new counsel. It can be done under Rule 11 and it would be new in this situation but failure to prosecute her is such tyrannical injustice that we may get to see that utilized. I know it is being discussed.

Didn’t claim it would be operational necessity. Just saying she would have a defense. It’s not a slam dunk.
