Here is some legitimate overreach when it comes to prosecuting sexual abuse:New Jersey state Assemblyman Troy Singleton has drafted a "rape by fraud" bill that would make it illegal to lie your way into someone's pants. From NJ.com:
Earlier this month,state Assemblyman Troy Singleton(D-Burlington) introduced the bill(A3908),which would create the crime of sexual assault by fraud, which it defines as an act of sexual penetration to which a person has given consent because the actor has misrepresented the purpose of the act or has represented he is someone he is not.
The bill was inspired by the case of Mischele Lewis, who lost $5,000 to William Allen Jordan,a man she was dating who pretended to be a British military official in order to squeeze money and sex out of her. Jordan was convicted of fraud, but attempts to charge him with sexual assault failed since lying to people to get them into bed isn't actually illegal. Singleton hopes to change that with this bill.
While Jordan sounds like a first-class scumbag, this kind of legal overreach is a very bad idea. For one thing,Jordan did get convicted of a crime,suggesting that the legal response to men like him is already adequate. But more importantly,this law is so vague and wide-reaching that it's easy to see how pretty much everyone could be considered a rapist,because, as any quick perusing of OkCupid can tell you,representing yourself as someone you are not is a universal behavior. All of us are claiming we woke up like this, and we are all lying.
Given that this law has very little chance of passing, it shouldn't matter much. But it does! Because it gives those who oppose any legislation attempting to address sexual abuse(affirmative consent laws, for instance)the ability to point and say:Look, those crazies think everything is rape,even fibbing!....

This really is a terrible idea, can you imagine the witch hunts that will ensue when dating buyers remorse hits?! This is just wrong on so many levels, not the least being that we will produce an even more humorless and litigious society.

If lying your way into someone’s pants becomes a crime, then they should station police at bar entrances at 11 PM.
I think part of what offends is that we have enough problems with relationship violence already, without introducing criminal charges of rape against someone in hindsight. We’ve all dated lying psychos, this bill just hands more tools to the same people the bill was written to punish.
Is this a 2 way street?
My x wife pretended to be fun, frisky, happy and well adjusted and less than a year after we got married, that façade finally failed completely.
Can I sue her or is her now being labeled bi-polar a get out of jail free card with this? What is the statue of limitations on this because that was kind of a long time ago.

If that wasn’t a rape-rape then I do not know what is. We got f**ked without our permission. We at least knew we were being lied to.
Though it needs considerable fine tuning, I can imagine several circumstances where “rape by fraud” is a legitimate complaint.
1) A man goes to a popular singles bar in hopes of finding a romantic partner with the eventual intent of marriage and children. He sees what he believes to be a woman, and makes polite overtures to “her”, to which she is amenable. So he spends time with her, buys her things of value, over the course of several dates, and eventually they go to a hotel room he has rented, where he discovers that “she” is actually a “he”, after sex acts have happened in a darkened room.
By this ruse, he has been defrauded of his time, effort, money, and possibly his good name and reputation, becoming a butt of jokes, and a subject of scorn. And, with a change in the law, he might also be considered a victim of rape by fraud.
Often when this happens, the man is enraged enough to physically assault the fraud, for which he is arrested. Currently, the fraud is no defense, and his case is treated as if he just spontaneously decided to assault the transvestite.
2) A similar situation, in which a man is hoping to find both a mate and have children with her. But the transvestite has had a sex change, so its genitalia appear to be those of a female, but it cannot bear children.
Likewise, this is a fraud, but only if the sex change does not inform their husband of what they really are. Again, the courts dismiss what might be years of fraud against the husband, and his diminished ability to find a fertile wife. He has, in effect, been raped of his fertility, through deceit.
3) A truly vicious deceit is if one partner goes to lengths to conceal that their family has a severe genetic disorder. One such case was of a woman who, abetted by her family, concealed that all male children born in her family were congenitally blind. This remained a secret until she gave birth to triplet boys, all blind.
To describe this as rape by fraud is actually insufficient, but the injustice it inflicted is palpable.
4) The most common form of rape by fraud is, as you might suspect, stolen valor. For the courts to dismiss this in an offhand manner, as they have in recent years, is just despicable.
