The Food and Drug Administration (FDA) for the first time on Friday used its authority under a 2009 law to remove cigarettes from stores.
The FDA is forcing Jash International to stop selling and distributing its line of Sutra Bidi tobacco products in the U.S., and is giving retailers 30 days to pull the products from shelves.
The FDA said Jash did not submit updated applications for a line of cigarettes up for review under The Tobacco Control Act.
Companies with tobacco products on the market when the law passed in 2009 had until 2011 to prove they met new requirements. If they failed to do so, Congress gave the FDA the authority to declare the products illegal.
Friday marks the first time the FDA has ordered a manufacturer of cigarettes to withdraw a product from the market.
The tobacco industry has been under a sustained assault by the Obama administration and Democrats in recent months.
Health and Human Services Secretary Kathleen Sebelius pledged in an op-ed on Friday that her administration was working to make the next generation tobacco-free.
In January, the surgeon general released a report detailing new health consequences related to smoking to mark the 50th anniversary of its landmark report tying smoking to lung cancer.
The surgeon general proposed new end game strategies aimed at the 42 million adult and 3 million young adult smokers in the U.S., such as hard-hitting media campaigns, tobacco excise taxes high enough to deter young smokers and easy-to-access cessation treatment.
Meanwhile, some retailers are also beginning to consider whether they want to sell cigarettes at all.
The drug store chain CVS Caremark earlier this month announced it would phase out cigarettes, chewing tobacco and cigars by Oct. 1.
"We've come to the conclusion that cigarettes have no place in a setting where health care is being delivered," said CVS Caremark CEO Larry Merlo.
Democrats are urging other stores to follow CVSs lead, sending letters to Wal-Mart, Walgreen Co., Rite Aid Corp. and the National Association of Chain Drug Store urging them to stop sales of tobacco products.
In its Friday release, the FDA touted its new control over the tobacco industry.
Historically, tobacco companies controlled which products came on and off the market without any oversight, Mitch Zeller, director of the FDAs Center for Tobacco Products, said in a statement.
But the Tobacco Control Act gave the FDA, a science-based regulatory agency, the authority to review applications and determine which new tobacco products may be sold and distributed under the law in order to protect public health.

I don’t know if every CVS does. I guess it depends on the state. But I have seen booze, not just wine and beer at CVS.
The allotment for space for complete trash is astounding. Most of the employees don’t even know they have a pharmacy.
Prolly a good thing there, or most of the employees would be hanging out in the pharmacy.
Months? More like decades. Seems a relatively 'poor' family with 5 acres of land, a couple of barns, and the willingness to work hard used to be able to send a kid (or two) to college off the revenue from the crop.
Can't have someone who isn't in thrall to the bankers or the government, now, can we? Can't have no po' folks gittin uppity and working their way up, neither.
That problem could be self-limiting. Pity about the collateral damage.
How many people have had car accidents as the result of smoking a cigarette? None at all.
Actually, enough that most insurance companies will charge a tobacco user a premium--even on their car insurance (think of dropped 'cherries' and trying to keep your crotch from catching on fire).
A distraction, granted, not as bad as 'texting' or the 95% of idiot drivers I have seen who were on the phone, but one of the first identified.
Sadly, "tobacco user" also covers those of us who use smokeless tobacco, and we aren't going to burn any tender parts with that.

If you are overweight, I despise you for having medical problems I have to pay for. If you eat fast food, I despise you for clogging your vessels with fat and causing you to have heart problems I have to pay for. If you drink alcohol, I despise you for drinking and causing medical problems I have to pay for. If you have a genetic disease given to you by one of your parents, I despise them for not aborting you so you wouldn’t have medical problems I would have to pay for.
When one human thinks he/she is superior to another due to “x” and wants to change other people to be more perfect like them, we have wholesale slaughter at some point to make all people alike which is never going to happen and millions die needlessly - that has been tried by despots the world over.
You are an individual and I don’t care what you do with your life as it is up to you. We need to butt out of other people’s lives because there is no perfect person - Jesus Christ is perfect and He’s the one to talk to about our own choices in life.
At the moment, I am smoking a Pall Mall menthol light cigarette. It’s my house and I can do whatever I want - so far no one has arrested me for smoking in my house but there are those who would want to do just that. They will want to come after you if you do anything like I listed up this post.
When one of us is arrested for being free, the rest, including you, will also be arrested for something. It’s a choice - don’t judge others and want something done about them, because you will be next. I wish people could see this happening but they excuse themselves, being sure they won’t be one of those removed from society for the good of the rest of society - that will be death to them, too.

No, but that's not the point of these tyrants.
The fact that they DON'T LIKE what you're doing is reason enough.
Harm? Hardly. The most important thing is that you OBEY.
I found out from someone with similar symptoms (and better doctors--mine tried to tell me it was "my imagination" and got fired on the spot) that they'd had a developing ulcer in the small intestine just beyond the duodenum... (I wonder if tobacco juice kills heliobacter pylori?)
Anyhow, I not only feel better, I use tobacco where I darned well please, no spit cup involved.
He ended up with brown teeth, but he didn't care.
I remember we were rounding on some patients at another hospital. He drove, and he smoked the entire way.
Normally this wouldn't bother me too much, but he had bumper stickers that said: "No Newts is good Newts".
And "Clinton '96"
Now THAT bothered me.
To make matters worse, he LOOKED like Clinton.
So I was glad when I didn't have to work with the guy anymore.
Clinton supporters would be hard to tolerate, but, thankfully, I work in an industry with very few liberals (they just don't last long).

My post is the truth. I posted on another thread yesterday I think is was, that I am so old I remember when we were free. It won't be long in the future when people won't know what freedom is as their lives will be regimented by federal law.
To defeat the above happening to me, I created my own country and I am president for life of my country. My country consists of my house and back garden. It is a complete country and I can lock my front door and not need anything from a utility company or any store for a very long time and still have a decent standard of living. If you have read Atlas Shrugged, I can be John Galt the minute I lock my front door.
More and more, you see the rejection of individualism and the magnificent mosaic it creates.
The human spirit's being crushed by collectivism and the yearning for sameness.
I don’t think the states that are addicted to tobacco tax revenues are going to like this.
