Ted Cruz graduated at the top of his class at Harvard Law so he knows that only SCOTUS can ultimately clarify whether he is NBC after an inevitable challenge from Democrats or GOP primary opponents, IMO.

Sean Hannity is a serial sellout. He certainly is no constitutional scholar. Personally I think he wants Rubio in 2016 who is arguably not eligible so he’s looking to make Cruz elibible also. I love Ted Cruz but I don’t think either he or Rubio are technically eligible but if they let Rubio run they better let Cruz run.
