very fascinating. it seems pretty clear that the agents know they dont have the right to do what they are doing, and once challenged they back down.
could also be that the driver seems obviously to be a native of the US, and maybe they think it just isnt worth the hassle. i wonder if the same result wold have been if the driver spoke with a heavy accent.

When you are at a border checkpoint you are technically not yet in the country. You are not considered in the country until after you have cleared customs. So your civil and constitutional rights appear to be stuck in no-man’s land.
And yet from what I understand they cannot actually deny you entrance if you are a US Citizen. Exactly when and how to push this I guess is the issue.
I enjoyed and learned from this video, thanks. I like the technique of responding with questions instead of answers such as “Am I being detained?” followed with “Am I free to go?” and pleading the Fifth.

True, but the elephant in the room here is the Border Agent’s lack of instantaneous judgement that the driver is obviously fluent in English.. Let him go. This is like TSA doing a search on a disabled American baby in a stroller. ALL COMMON SENSE GOES OUT THE WINDOW IN THE NAME OF POLITICAL CORRECTNESS and treating everyone like criminal.
Aren’t there ways of going state-to-state by using roads without checkpoints instead of major highways where there is one?

What good is a checkpoint 75 miles from the border. We have them 55 miles north on I-5 and 15. Once a year they stop some idiot with mj in their trunk. This is what we get for tens of millions in costs per year. Set up a checkpoint in sanctuary cities.
I think most people (especially me) think authorities should patrol and secure the actual border, and not hassle citizens inside the United States. Many years ago the actual border was patrolled and fairly secure. The powers that be decided there was no need to patrol the actual border. It was decided that enforcement on major roads near (now up to 75+ miles from border) would be more effective. We all know how well that has worked out; illegal traffic does not need a major road. In practice once illegal traffic does make it to a major road it is nearly impossible to get them.

The problem is that Border Patrol Agents are not able to only ask people that violate the law questions. It’s called racial profiling. So they have to ask everybody. Unless of course you are me then you only stop people that are violating the law.
You raise a good point. Unfortunately, this is the kind of thing that happens with political correctness runs amok. There was a time when agents only asked for the citizenship of people that looked and acted like illegal aliens. To do so now days is considered racial profiling and agents are required to ask people they know very well aren’t foreigners or illegal aliens questions of citizenship.
