John Roberts is currently in position similar to Benedict Arnold after West Point. Keep in mind that Arnold was a hero to the Revolution, instrumental in a number of hard-won victories and severely wounded in battle. But in his mind Arnold struggled between the cause of American independence and personal recognition. In the end, in one fateful decision he joined his former foes.
We are not in a shooting war and John Roberts need not fear the noose, but he does share a problem with Arnold. The Americans made Arnolds name synonymous with treachery and the British didnt trust him. Im sure the Roberts decision on ObamaCare was seen by him as Solomonic. It wasnt, and as his decision is analyzed and as sources in the Supreme Court expose the deliberations, Roberts will be seen as a man who put self before principle by his previous allies. The Left will take what he can give them but always view him with ambivalence.
The composition of the Court also makes it impossible for Roberts to recover his previous position as a moderate Constitutionalist. There are four Liberal votes on the Court who vote as a bloc on important issues that divide Conservatives and Liberals. Roberts can guarantee a Liberal majority in these cases, but cant reliably deliver a Conservative one. By crossing enemy lines, he may have no choice but to join their side wholeheartedly if he wishes to leave any legacy except that of a failed traitor.
We may, unfortunately, have to live with that.
He will be known as the man who allowed the downfall of America. History will frown upon this vain man.

When the history books are written, scholars are going view Robert’s decision on health care as the officially recognized beginning of Post-Constitutional America.
We should never refer to his infamous decision by any title other than “Roberts vs. The Constitution.”
Narcissistic Roberts just made himself “the swing vote” on the Roberts court.
The toadies will line up to kiss his feet and sing his praises.
That is what will become of Roberts. Sadly, we didn’t scream when a newcomer was nominated for the chief justice chair. Could Scalia or Thomas have made it through confirmation? Who knows, but it should have been tried. With Scalia, it really would have been replacing a very conservative justice (Rehnquist) with a very conservative justice. That might have worked. In Thomas’ case, it would have been another elevation for an African American. Anita Hill might have been called on again, so better to try the Scalia route. But an unknown, new justice as Scotus chief? In retrospect, we should have screamed as loudly as over Harriet Miers.

Roberts has taken one powerful option off the table. There are many other paths, starting with the ballot box. The problem is that if we lose there, whether to fraud or to simple foolishness, there is one less stumbling block short of another civil war to stop the emergence of a totalitarian government. As terrible as ObamaCare is for the American people, the loss of constitutional protection will likely turn out to be even worse.
I don’t think Roberts would resign while Obama is President.
