I think you are onto something here. This is what you end with when you enact a law with legislative intent expressed in one direction and then completely switch gears after it is signed into law. You wind up with scrabbled eggs.

I am not certain, but IIRC, the waivers were time-limited. I suppose they can be renewed in a rolling fashion, but again, not certain that would satisfy the Equal Protection clause.

After January 2014, the first people who are negatively affected by this law can sue.

Were those waivers on the mandate to carry a minimum coverage, or were they on the excise tax on the “cadillac” plans?

Every waiver ought to be canceled post haste. No sweetheart deals for Starbucks and McDonalds and the hundreds of other companies that made deals with the snake in the White Hut.

Anyone on waiver is now classified as a loopholer. Classifying this as a tax has turned this into a Giant Turd sandwich and the Zero took the first bite he just doesn’t know it yet.

It’s a good question. But the answer is, as long as Obama is president, and the courts enable this president, realistically, this president will continue to do whatever the h*** he wants to, and will push the envelope in other areas, based on this court precedent.
