Here's What Will Happen To George Zimmerman Next In Florida

We know George Zimmerman will be charged. Here’s what will happen next on the State Court level. There are now certain formalities that must take place as required by the US and Florida Constitutions. He will either be arrested or have an opportunity to turn himself in. An arrest is a good bet. But there are certain benefits to his turning himself in while accompanied by a lawyer.

He will be arraigned within a short period of time where a Judge or Magistrate will tell him what the charges are, the possible penalties, and set a bond. When setting a bond the official looks at the gravity of the crime, community connections, employment, criminal history, flight risk, substance abuse, and the like. It is also a positive if a lawyer comes in and explains how these factors apply to his client.

Where Zimmerman “disappeared” to will have a bearing on any bond. If he left the state, then all bets for a bond are off. If bond is granted, it can be personal recognizance, meaning that Zimmerman promises to attend all future court hearings or face a big monetary payment and probable immediate incarceration. Not likely here.

It can be a cash/surety bond, meaning that he has to get a bondsman to post the bond or the defendant must post the entire bond amount with the Court. This is possible.

In some states, there is a cash/or percentage bond set. This means that he can put up a percentage of the bond with the court and if he doesn’t show up later he forfeits the entire bond amount.

Next, before everyone gets excited about a trial, since he will be charged directly by the Prosecutor with an "Information,” and not charged by indictment by a Grand Jury, a Preliminary Examination...

I assume you mean the prosecutor. Why is it easy?

Conviction? Gonna be tough.

Which makes may wonder why it's an easy call.

All they have to do is get 12 jurors who are already convinced Zimmerman is guilty--that should not be hard to do (cf. the Scooter Libby trial). It doesn't matter if they are black or white--there are plenty of white liberals who are convinced of Zimmerman's guilt.

The Sixth Amendment is supposed to guarantee a defendant an impartial jury but I wouldn't count on it. The same amendment guarantees the defendant the right to the assistance of counsel--but there was a case a few years ago in Michigan where a man was denied the right to counsel and was found guilty--and wasn't allowed to appeal the case.

The Fifth amendment is supposed to require the involvement of a grand jury but it sounds like they have decided to ignore that rule.

Two things:

1. If Zimmerman's legal counsel doesn't think he can get a fair trial before a jury, there's always the option of having a non-jury trial in which the judge makes the ruling.

2. If charges are brought, the best thing that could possibly happen would be for the prosecutor to file an indictment for a ridiculously serious charge that will never stand up under any legal scrutiny. This has happened occasionally in New York City in cases involving police shootings ... in which an "over-zealous" prosecutor files a murder charge because he/she knows damn well that the police officer will never be convicted.

#2 wont happen. The only charge more severe than second degree murder is capital murder that requires a grand jury.

Second degree murder is serious enough. If the prosecutor goes ahead, it will be very difficult to convict him if the media reports about the case are even partially accurate.

On the other hand, a manslaughter charge would likely be much easier to prove.

A’s child, it would take a very courageous judge to find him “not guilty”.

If she had seated a Grand Jury in this case, they might not have returned an indictment, & she would remain a nobody. By issuing the indictment herself, this case is her ticket to stardom.

Win or lose the trial, all of America will recognize Angela Corey. She is many things, but not a coward.

Just like Marcia Clark, she is a COWARD and a DISGUSTING AFFRONT TO PROFESSIONALISM to have held the pathetic news conference she just had. No excuses. Sorry.. Her compliments to Trayvon’s family while neglecting Zimmerman’s is uncalled for. Her intermittent smiles were totally inappropriate. If this is the best women can do, we’re screwed. Oh that’s right, we ARE screwed. This is just as serious a matter for Zimmerman as it is Trayvon’s family, not a frickin’ bridal shower announcement.

There are some twists and turns here. Normally he would be offered bail if the judge decides he is not a flight risk; but in this case, his attorney can produce a written document that represents a threat to his life, issued by the NBP.

This could mean that the judge could direct that the proceedings be sealed from the public, that information such as where Zimmerman is staying would not be released. It would also defeat some of the publicity hounds that seek to railroad him in a show trial.

If his attorneys can keep the proceedings calm and collected, and objective, Zimmerman walks. He should, however, have other attorneys preparing a whopper of a lawsuit against those that have persecuted him and called for him to be killed.

I would love to see him get restraining orders slapped on such racial agitators.

This is going to be a High Tech Lynching of a Hispanic Man for the salvation of an only slightly darker man's political career. It's called racial hardball politics and if you're dark enough you won't lose your job period, you'll always get a pass. It translates down to incompetent worker's that are always allowed to take a pass. Ask yourself, is the job of President of the United States a position where we can accomidate an affirmative action hire?

Many people voted for BO, because we wanted to put the legacy of American racism behind us. In fact the dream of a post-racial America was in widespread usage by the mainstream press. Now, instead of racial harmony Mr. Obama, you have become the principal cheerleader in calling for a lynching as part of the outraged crowd. You must remember Sir, that as the President you're not merely a voice in the crowd, you're called upon to be the most colorblind man in America.

When you can't deliver a credible performance as our chief executive, you went golfing and didn't even attempt to sort out the nation's financial issues and present a sound annual budgets to the Congress and the citizen's of this country. You didn't just fail to submit one budget, in fact you have failed to present a budget during all three years of your presidency.

It seems to many of us that you are behaving just like an affirmative action hire that's coming to the American people with yet another dubious excuse of victimization.

If all we can expect from you is more obfuscation and hiding away your past misdeeds and fraudulent crimes, your legacy will be that of incompetent leadership, you should resign the office of POTUS.

Do not try to focus the nation's attention away from your substandard performance as POTUS. Shame on you for trying to shift the focus of the nation upon racist behavior, which white America has largely transcended, you are playing with volatile materials.

Quotas, scholarships and cradle to grave entitlements rob the recipients of developing character and self sufficiency. Let's be honest Mr. President, these magic formulas to someday achieve complete redress of racial inequity will never end. As long as somebody enjoys extra special minority rights, they have no incentives to pursue worthwhile lives. More importantly, you Mr. President were given as complete investigational pass and then you were forced down our throat's by the elite media. Many mainstream pundits knew of your communist ideology and hid it from disclosure. After more than three years of watching you run down American exceptionalism, the traditional hard working American public have had enough of you.

We are through providing you jet aircraft, housing, room, board, food wine and entertainment while you're busy looting the national treasury and sending our wealth overseas.

We are not racist and excel in our chosen occupations, we don't need the benefit of your quotas. Frankly, quotas should be an embarrassment to all the citizens of this country. Please don't ask us to sacrifice our dreams to make room for any more slackers and part-time workers. I'm appealing to your naturally lazy side, Mr. President please resign. Yeah. HER ‘CHARGE’ WAS POLITICAL, BIG TIME. Throw the blacks a bone, and delay the inevitable. I’m sure the media will release the names and addresses of all the jurors to ensure a GUILTY verdict.

He will be found not guilty of 2nd degree murder, might be found guilty of manslaughter.

I believe he has a good chance of being found not guilty. This is a special prosecutor, the original DA did not feel he had a case to charge Zimmerman.

After everything shakes out, the evidence will show Zimmerman did follow Trayvon, but it was Trayvon who initiated first contact and gained the advantage over Zimmerman.

If it is proven that Trayvon jumped on Zimmerman and he felt he was about to lose control of his firearm, he would be justified in the shooting.

If he feared for his life or that he was about to lose control of his weapon and had no way to get out of the situation, he would be justified in gaining control by shooting Trayvon.

My lil ol pinion.

If it is proven that Trayvon jumped on Zimmerman and he felt he was about to lose control of his firearm, he would be justified in the shooting.

Or it could be discovered that Trayvon, trying to wrest the gun from Zimmerman's hands, pulled the gun forward against Zimmerman's grip resulting in a relative backwards motion of Zimmerman's finger on the trigger, firing the gun.

,,,,, I like your opine ,,,, and I hope you're right . He definitely needs a change of venue if he opts for a jury trial ,, I think he may be better off letting a judge decide his fate rather then a mixed jury ,, but with his luck he'd probably end up with a black liberal judge . At this point I can't ever see him ever getting a fair impartial outcome .
