The lead attorney for Army Staff Sgt. Robert Bales, who is accused murdering 17 Afghan civilians last month, has complained that he and his team are facing an almost complete information blackout from the government.
Attorney John Henry Browne maintained that a government managed information blackout is devastating his investigation into the facts of Sgt. Bales case.
The broad outline of the crime he is accused of holds that the 38 year old Bales slipped into two villages on the night of March 11 and opened fire on innocent civilians wounding six people and killing 17 others including nine children and eight adults.
According to a spokesman for 1st Corps, Sgt Bales command, the investigation is ongoing. An E mail sent from Major Chris Ophardt says, The prosecution will provide the defense with evidence in accordance with the Rules for Courts-Martial and the Military Rules of Evidence. Within these guidelines the prosecution is and has been communicating with the defense.
But this doesnt satisfy Attorney Browne. He doesnt see the case moving along in an acceptable manner at all. He told an interviewer his team in Afghanistan has not been able to speak with injured survivors on orders from the Armys prosecuting team.
Worse still is the fact that Browne has learned that the prosecutors had spoken to them and they have subsequently been released from Kandahar Hospital Of course they are now not available to be interviewed.
At a recent press conference a frustrated Browne said, These witnesses are now who knows where people just disappear into the countryside in Afghanistan. They (prosecutors) actually promised us that if we sent people to Afghanistan that they would cooperate and make witnesses available for us, and they obviously violated that promise.

I’d bet that the targets weren’t random ,, my guess is that they (including the kids) were supplying intel to snipers/bombers regarding movement in and out of the camp.

You could be right, but I’m not sure that two and three year old girls could provide reliable intel to the snipers and bombers.
I’m no expert but have seen several general court martials. The accused always had a civilian lawyer. It was always someone who specialized in military law.
I just wonder, who will go to trial first, Major Hasan who murdered 13 innocent Americans in cold blood on November 5, 2009 or SSGT Bales, my money is on Bales. Sad, but Hasan should have already been tried and convicted and put to death.

My bet is the charges will be dropped rather than have that something exposed.
I was in the Navy for 23 years. I like this Sgt Bales. He’s not a bad kid. I agree with him on everything. Unfortunately, the military has rules about NOT being political. They tell The kids in boot camp, here are the rules. It’s not a democracy. Its a shame but a military member is not supposed to demonstrate. Maybe it seems harsh but he’s there to obey the orders of his superiors. I like the kid but I think he will lose his case.

Hasan is a Muslim who murdered infidels while screaming “Allahu Akbar!!” He’ll die in prison of old age like Khalid Sheikh Muhammad who did exactly the same thing. Besides, Hasan’s court-martial would open up a huge can of worms on his entire chain of command, most of whom are still on active duty. Nothing to see here, folks.
Sgt Bales is an infidel who murdered Muslims. He’s on the fast track to death row. No comparison.
A long story, but the charges were based of sworn statements of a discharged nurse, who had a brain tumor.

For that matter, does anyone even have a link to a formal listing of the charges against him?
If govt won’t comply with defense’s discovery requests, defense wins. Judges hate it when people act like stone walls during discovery
