2nd Amendment v. Stupid NJ Gun Laws - The 1st Court Opinion

Do you think a federal circuit judge can think for himself or does he have to be told what to think? When there's a Constitutional civil right case before the lower courts, why do these guys kick it down the road? Do we really have to wait years for a simple matter to be decided because of the frail egos of judges? God forbid they get overturned on appeal. No balls.

A more glaring deficiency is how easy personal ideology factors in. Some people have an agenda, as do I. The big difference is they are wrong and I am right. Also, they know I'm right yet they cling to the last vestiges of their utopia, hoping for a miracle. They'll stall for as long as possible, like a child negotiating those last precious minutes before bed time. Sad yet pathetic.

On January 12th, United States Senior District Judge William H. Walls handed down his opinion of the civil law suit I like to call the 2nd Amendment v. Stupid NJ Gun Laws. I think everyone knew how he would decide and no one should be surprised. Judge Wall was a Clinton appointee and a NJ native. He spent his whole legal career in NJ. The guy has the proper credentials for squashing the 2nd Amendment. And squash it he did.

Billy is a mere stepping stone on our way to freedom. Not being a constitutional lawyer myself, I still see some gems in his opinion that should be used on appeal. When these guys say or write dumb stuff it should always come back as a Stooges poke in the eye. Billy quotes some 1970's case that probably sums up the whole game plan of idiot lawmakers & dumb judges.

“[T]he overriding philosophy of [the New Jersey] legislature is to limit the use of guns as much as possible.”

Well isn't that great. These guys don't want us to use guns. Why? Because they are dangerous and it's a “reasonable determination that limiting the use of guns leads to fewer incidents of gun-related injury and death.” What a genius. At least we have it it writing now. That is the actual reason for all the dumb gun laws according to Walls. I'd circle back to that one for sure on appeal.

I guess the state should also have some sort of compelling interest in automotive safety. They can limit who gets to drive a car? Wait, don't I have to just pass a written, vision and driving test while meeting an age requirement in order to get a driver's license? I don't recall having to go before the chief of police and then a judge to explain the reason why I need to drive. Driving, walking or riding a horse isn't even mentioned in the Bill of Rights yet no municipality in the USA has a “justifiable need” clause in their licensing scheme. Yet, don't evil SUV's kill? How many people die each year in the Garden State at the hands (wheels) of dangerous vehicles and the tires they ride on? Could you imagine Billy having to defend some law that limits driver's licenses on the grounds that drivers may kill someone with a Ford. Classic.

I'll be deconstructing Billy's opinion for the fun of it in future posts. It really doesn't matter what dummy thinks. He's a footnote in this whole process. This is all about me having some fun with his 46 page masterpiece.

What is about NJ that makes it more dangerous for the law abiding populace to own guns?

The way to get around firearms laws in the “ People’s Republic of New Jersey” is to do what my wife and I did. WE GOT THE HELL OUT and moved to firearm friendly,Castle Doctrine ruled Pennsylvania where the Assault Weapon ban DID sunset.

The former Attorney General of NJ stated that if NJ were to grant right to carry, that more police would need to be hired to protect the citizens from those that carry guns. And this lickspittle moron is supposed to be the chief law enforcement officer of the state. Pathetic.
