Should public school officials have the right to prevent students from wearing pro-American garb on Cinco de Mayo?
This question has been at the heart of a California court battle between the Morgan Hill Unified School District and students who were told by a principal and assistant principal that they could not wear American flag t-shirts on the Mexican holiday back in 2010.
Following the incident, a lawsuit against the district was launched by the students and their families. This week, the case came to a close, with a federal judge ruling against the students a blow that is likely to infuriate some free speech advocates.
According to U. S. District Court Judge James Ware, the district did not violate the students first amendment rights. The judge also found that officials concern over the potential violence that could be incited by the students pro-American outfits justified the schools actions

Congress is not doing it’s job! there are at least 100 federal judges who should be impeached and thrown off the bench for failing to adhere to their oath.

One answer could be “jurisdiction stripping”, which allows the congress to set limits on which cases the corts can hear. Read more at:

How about next year a group of American students at this school be offended by the Mexican flag and get the case before the same judge? It would be interesting to see how he rules on that.

I understand the concept the Founders desired in having a judicial branch that was “free” from politics to be “honest brokers” in regards to interpretation of law.
However, I must question if this is really happening anymore? Judges are human and bring their bias and opinions with them to the bench. We must realize this is a fundamental truth that cannot be escaped.
It is time to put forward an Ammendment to the Constitution that makes ALL federal judges subject to “votes of sustanment” on a regular basis. Let the President nomininate and the Senate confirm....but not for life time appointments where those in essence “governed” by these judicial appointees are not answerable in any way to the people they, in essence, rule over.
Once placed in a federal judicial position, to include the SCOTUS, a “judge” should be subject to being voted on by the “people” of their jurisdiction every 4 to 6 years to see if the “people” are willing to allow that judge to continue to serve in that capacity. Judges that are NOT sustained by greater than 50% of the vote would be immediately removed from their appointment. This process is already practiced in many states for judges in State Supreme Courts. The people may not directly put a justice in place, but they have a mechanism to remove one.
It could cause disarray, but the federal judicial system is broken and “Black Robed Tyrants” rule with no checks by the people. This needs to end. It is trully time to ammend the U.S. Constitution regarding all levels of federal judges, making them accountable for sustainment in their positions on a regular basis by the people they “rule” over.
