November 1, 2011 Cain Accuser Wants to Tell Story, Lawyer Says By MICHAEL D. SHEAR and JIM RUTENBERG The lawyer for one of the two women who accused Herman Cain of sexual harassment said Tuesday that she wanted to come forward but was bound by a confidentiality agreement with the National Restaurant Association.

The lawyer, Joel P. Bennett of Washington, said in an interview that his client was calling upon the association to release her from the confidentiality agreement so that she could speak publicly about what happened with Mr. Cain.

“He’s no longer an employee of the National Restaurant Association, so the National Restaurant Association could argue that well, he’s no longer an employee so it doesn’t bind” the women, Mr. Bennett said.

Appearing on Fox News on Tuesday evening, shortly after The Washington Post first reported Mr. Bennett’s comments, Mr. Cain declined to call on the restaurant association to release the woman from the agreement.

“I just found out about this today,” Mr. Cain said. “I can’t give you a definitive answer on that until we consult with our attorneys.”

Mr. Cain said that there could be “legal implications” if the women involved were released from the confidentiality agreements. He did not say what those implications might be. He also said he did not think that he had waived confidentiality by talking about the incidents.

“I never used the name,” he said. “I don’t believe that I have.”

Baseless claims are settled everyday, bar none. The costs of defending are measured,,and if the golddigging lying chik will dismiss the claim for less,,they pay her, and get a confidentially agreement. Totally standard.

This is all a Red Herring ...

The Main Stream Media, the Liberals, the Democrats, the Socialists, the Marxists, the Communists, the Libertarians, the MainLine Republicans, the RINOs ... the Rich and Powerful who intend to do whatever they need to do to stay rich and powerful ... all KNOW that The Only Person Who Can Face Off with Barack Hussein Obama is another Black Man.

The only person who can confront Barack Hussein Obama is not just a black man, but an American Black Man, a successful businessman, a conservative, a believer in the greatness of the United States ... a Cain to confront an UnAble-Obama.

And I believe that it’s not JUST Obama, the Democrats and Soros but also Romney, Perry, Ron Paul, Trump, and a host of GOP leaders who want to undermine Herman Cain ... just as they continue to undermine Sarah Palin ... but to a lesser degree because she is not a Candidate.

Think about it ... Herman Cain is not a politician ... every other person running for President IS a politician ... and whether We The People can prove it or not they ALL are involved in this smear to some degree ... even if it’s just by being silent and not supporting their ‘fellow’ Republican candidate.

My next question is ... can you submit proof that any of the other GOP candidates are supporting Herman Cain? I would hope that at least Michele Bachmann is. I don’t see anything from Sarah Palin yet. Anyone?

And no matter WHAT Cain has done-—Clinton was MUCH worse and got a pass. They didn’t parade the rape and Juanita Broderick about, and the press attacked and destroyed Paula Jones, etc, etc. NOT CLINTON......and hid the dress with the semen on it....and portrayed Clinton with a huge Bible the morning he was masturbating with cigars or whatever. Democrats are sick perverts.

That x-pervert in chief is still glorified by the press as was Ted Kennedy. Puke.

The MSM is such a fraud. They are the ones that say this kind of behavior gets a pass.

I don't think the agreement is between her and Cain but between her and the association. There is no reason why they should release her from it.

Her grievance is with the organization. Cain could not be party to any of the investigation, findings or settlement.

It can’t go anywhere but “bad.”

This woman can say whatever she wants and try to force Cain to get into a debate with her, etc.

Politico’s mission accomplished: Cain has to spend try responding to unrespondable-to garbage instead of running for president. How convenient. And at the end of the day, there will be nothing more on the table anyway.

Confidentiality agreements are supposed to be for all time.

Please don’t forget how President Obama operates. When he was running for the senate, his opponent had sealed divorce proceedings. The Democrats got them unsealed, and Ryan withdrew from the race.

I don’t think Mr. Cain has done anything, period; and because this woman received a settlement that should end it. The Democrats, however, only understand the idea of winning, anyway they can.

Oh, come on. Sorry, but what world do you live in?

The Left, through the infamous Equal Opportunity Employment Commission and their buddies in the trial lawyer bar, creates this culture where employers would rather pay someone a few months’ salary severance (a, gasp!, “five-figure settlement”), or even millions of dollars, to get rid of them rather than have to fight even blatantly false charges.

Then the Left uses the fact of these “shut up” settlements to say, see, that man, that company must be awful, someone actually made a SEXUAL HARASSMENT CLAIM against him!!

The fact that we so often fall for this shizzola, and start responding as though there is some “there” there, when the facts show there is no “there” there, is stunning.

This is ALL Politico was trying to accomplish: to disappoint, discourage and distract the conservative base.

It hangs on what Cain actually did. He can fumble around all he wants in his explanations as long as there’s no dirt underneath, and I don’t think there is.

The accusers might have grabbed a tiger by the tail, as embarrassing (or worse) things about their lives might become national news.

If there was a pitched battle over whether or not to endorse Cain 2 weeks ago, about the same time Martin started to probe this story, did someone opposed to the NRA endorsement and perhaps collaborating with the Obama campaign leak this to scuttle the endorsement? Let me adjust my tin foil hat and mention that the person sitting in Cain’s old job there since 2007 arrived fresh from running AARP...as in Obamacare...Obamacare waivers....

It reads like standard legal procedure. You don’t want the settlement terms made public to avoid “encouraging” others. If others know they can get x dollars just to agree to no further legal action, how many others will jump on the bandwagon?

From what I’ve seen, most of the time the prospect of “losing” in court or before an arbitrator has nothing to do with the motive to settle.

Many of these complainers are just that complainers — often serial sexual or racial harassment complainers. At some point, they are just a drag on the workplace. No one wants to interact with them and certainly won’t willing agree to work with them or travel with them on a team or one-on-one basis. And risk an unfounded complaint? NO WAY.

Writing them a check is just easier and safer and allows everybody else to get back to work.

Often the employee goes to the next job and does the same thing.

It can be a tidy second income for quite a while.

I presume you have never attended a "Sexual Harassment" seminar or been the accused male. I once paid a sincere compliment to female coworker [same employment ranking] that she was smarter and better looking than me. This got me reported me as being a harasser on that SINGLE STATEMENT.

I had to attend a "Sexual Harassment" seminar and 5 sessions of counseling where I learned that females were a superior class from a female sociologist. Then I was fired 3 weeks later as a "Reduction in Force" (RIF) BUT my coworker's female room-mate was hired in my place. Coincidence or calculation?

In this case, it appears that he, Cain, had two separate instances of a subordinate who makes an accusation. This is an industry (restaurants) representation firm, in essence being a public relations and lobbying organization. Defending against a perception of one's offense becomes a "she said, he said" and remember this was the 1990s right after the Clarence Thomas and Anita Hill prime time show trial! WHAT WOULD YOU HAVE DONE - fight it in the press and court or given money that it would already cost to defend and everybody goes away?

But WE can and should stop talking about it.

As far as I’m concerned, we simply need to refocus on the campaign and say those questions have been asked and answered.

Since it seems most people have concluded there is nothing here that impugns Mr. Cain’s character or conduct, the matter ought to be dropped.

Yes, the LSM will try to keep it going for a while, but there’s only so much talking they can do to themselves and without the “fun” of getting a rise out of conservatives.
