Cain: Gun control should be a “state’s decision”

BLITZER: How about gun control?

CAIN: I support the 2nd amendment.

B: So what’s the answer on gun control?

C: The answer is I support, strongly support, the 2nd amendment. I don’t support onerous legislation that’s going to restrict people’s rights in order to be able to protect themselves as guaranteed by the 2nd amendment.

B: Should states or local government be allowed to control guns, the gun situation, or should…

C: Yes

B: Yes?

C: Yes.

B: So the answer is yes?

C: The answer is yes, that should be a state’s decision.

As far as I can tell there are very few FReepers who understand that the writers of the 2nd amendment didn’t even mention permits. I am one of the very few who are yelling that we must get off of our knees if we ever expect freedom. I believe marktwain will back me up on what I just said.

Cain isn’t running for a state position. Whatever he thinks various states can do is irrelevant. He has clearly said that gun control is not a federal concern. He’s right about that.

I’m willing to give him a mulligan on being backed into a “states-rights” sort of answer.

You know, I really do like Cain but this is just a dumb answer.

Or maybe you (and others here) misunderstand Cain's answer.

Every law of every State is subject to the prohibitions and limitations in the United States Constitution. What Cain is saying is that the States, rather than the Federal Government, should be responsible for the regulation of firearms, provided, of course, that the regulations and restrictions comply with the 2nd Amendent. This is not a hard concept.

So, you support state-level restrictions on firearms, so long as the right to bear arms is not infringed in any way? Can you give an example?

I’m pretty certain that the the 2nd Amendment allows a state to prohibit convicted felons, extremely young children, psychos, and the mentally impaired, from possessing a firearm.

True but the facts are that he was correct in saying gun controls are a state matter. We are the ones to blame because we, the voters, are who seated these nincompoops in Congress and the Senate. We are the ones who don’t march or even call and protest when they violate the Constitution.

What part of "shall not be infringed" contains the loophole barring pyschos, children and felons?

Look, I understand the sentiment. I might agree that those are sensible restrictions. But, based on the Constitution, as the highest law of the land, I see no legitimate way for any government body to restrict gun rights. We can wish otherwise, but I don't see exceptions within the language of the 2nd.

The Constitution has an amendment process that can be used in cases where the original document is less than perfect. But until amended, it says what it says. And it says "shall not be infringed".

No signatory of the US Constitution can diminish any part of it. State gun control is unConstitutional. Period.

From Federal infringement... Correct. Apparently, where this falls apart is at the State.

Re-read Article 6 Paragraph 2 and try to explain to me how any State that is subject to our Constitution and the Bill of Rights can supersede the express limits in said Constitution?

I’m a hillbilly cowboy, not a lawyer. Your view, whatever that may be of Article 6 Paragraph 2 is just fine with me.

You are framing the question incorrectly.

There are some gun laws that do not infringe on the right to keep and bear arms. For example, a state can forbid prisoners from bearing arms.

Ah... So what “due process” have the rest of us undergone to have our Rights removed? What tort have we created by the simple, and peaceful, expression of our Rights? Are we being punished absent trial for simply wanting to be free?

You have switched your argument. I do not follow it. Most State gun laws are unconstitutional, but not all of them.

Cain is referring to pre 1890s, pre 14th amendment and pre incorporation of the BOR...I guess.

Either that or he's consumed too many bad pizzas.

The Bill of Rights Does not give anything to the people. The BofR was written for the Government, Federal, State, and local.

“..shall make no law”, “..shall not be infringed.”

My right to keep and bare arms comes not from the 2nd amendment, but from God.

If this is too much for you to grasp, vote for the “0” and he will take the worry from your shoulders.
