I'm looking for anyone who can suggest a way to force Capitol One to issue a "paid off" automobile title (paid off 3/11/08).
State of KS tells me that they have an "electronic title" still showing Onyx Acceptance as lender. Onyx sold to Capitol One a few years ago.
I'm unable to reach Capitol One - period. Sent fax requesting clear title or title release to Capitol One to be either sent to me or State of KS - no response.
Phone numbers listed are either no longer in existence or I get a computer generated answer that asks for my loan number, which is no longer in existence. Even after I continue to hold on, they disconnect me.
Lady at DMV in Topeka tells me that she needs release and I tell her that I've attempted to reach someone, anyone either at Onxy or Capitol One, anywhere. Ask her what to do, she says I need to "file a lawsuit through the court" but won't tell me where at Capitol to find out.
Anyone else had this problem and settled it?
Go get yourself a duplicate title. Sometimes known as a Certified Copy of the Original. Apply for a lost title with your state.
Anyway, once you have it, it may not even list a lienholder on it. But if it does, take it to the nearest branch or office of that lienholder and have them sign off on the release.
If they refuse, then kick their ass. (No wait. That would not help...)
Unfortunately, the “system” is set up to feed the lawyers.. which is likely what you will have to get to work this out.
One could probably file a small-claims case against CapitalOne... but good luck with that - it could stretch for a LONG time.
A GOOD lawyer could likely get this straightened up (assuming you have all your documentation) in a week.
One thing I am wondering - if you are having this kind of trouble - how many other consumers out there have run into the exact same problem resulting from Onyx being sold to Capitol One? I would wager that you are not alone.
Some states will provide a temporary license with documentation. Last time we paid off a car loan it took six weeks to get a release. Good luck.
Never had such a problem. I would suggest calling the better business bureau and asking their advice. Then there are “consumer advocates” some tv and newspapers have to handle such problems. Or contact the state agency which handles licensing for loan companies. Contact your state representative or Senator and see it they can put some pressure on the agency should it be reluctant to get involved. Hit ‘em from many angles.
There is no gain for the company to not give you title.

You need a letter from them saying it was paid off. then go to any licensing bureau with that letter and they will fill out the papers to issue you a clean title. As suggested, contact Customer Service to request the letter.
You should have received a paper title when the loan was paid off in 2008. When I pay off a car, I start bugging the lienholder for the title immediately just to avoid problems like this. But, that doesn’t do you any good now.
Check the web for other contact numbers for Cap One. When you call the number, they ask for account number, SSN, or phone. Try all three and see if any of them get you to a human.
Unfortunately, I’ve done all that you suggest with no result, company phone system has to way to connect with a person for a loan that was paid off. The number as well as my social are no longer in system, ultimately hang up on me.
File for a replacement title from the state. Capital One cannot issue you a new title. Banks do not issue titles. Only after you have a new title from the state can you address getting the lien removed. That usually just means a notarized signature from the lien holder.
You can file a small claims action — every large company has a office to use as the respondent to the action.
It is surprising you can’t reach anyone. I suggest you go up the food chain. If you have a lawyer, have him/her send a very official letter requesting the title be released.
At this moment, they are on the verge of committing a crime in keeping your property that you have paid for in full.
You need to let them know that.

The problem is Capital One is a co-title holder. They can’t issue a title, but they have to release themselves as lien-holder, co-title holder. You also are supposed to get the pink slip.
It is usually pro-forma but I had a similar problem when one bank sold my note to another one month before I paid my car off. It took a few weeks — then I got 2 releases and 2 pinks.

Unfortunately, they were NOT my original loan originator but Onyx was then sold out to Cap. One.
Will refuse to ever use Cap. One in the future.
