Under this act, any new legislation that proposes a mandate on state and local governments estimated to cost more than $50 million dollars must have a Congressional Budget Office (CBO) estimate and provide the funding to pay for the mandates.
How many states are going to have to deal with unfunded mandates that far exceed $50 million dollars and into the tens of billions of dollars each year and pertain to a host of services that will have to be funded by the federal gov't under ObamaCare?
If the unfunded mandates are funded, that would skyrocket the actual cost of ObamaCare.
Something else to add to the mix:
1.) The commerce clause deals with the regulation of commerce. How can the gov't regulate commerce if someone doesn't engage in commerce?
2.) How can the gov't force people to buy and sell and work jobs to buy and sell and engage in commerce? The gov't cannot force someone to work, so they cannot force them to engage in commerce.
Given the commerce clause deals with the regulation of commerce, the gov't therefore cannot force anyone to purchase health insurance coverage under ObamaCare, per 1 & 2.
What say you?

There is a simple solution. Repeal the damn thing and jail everyone who voted for it.

Another solution is for Republicans to pick out all the parts that are especially reviled by the public and parts that Democrats would therefore have a very hard time saying no to repealing.
Hammer away at them and demand that they be repealed til Nov. 2010 to 2012 and to 2014. If Dems resist, they stand a very good chance of being ousted.
When enough parts are taken out, it will be like a car stripped of its fan, its carburetor and its battery.
ObamaCare would still be around, but just like a car without those parts it wouldn't run.

Everyone here should send the AG’s filing lawsuits against ObamaCare a fax pertaining to Bill Clinton's Unfunded Mandates Reform Act of 1995.
If the cost of the unfunded mandates will far exceed $50 million in each state (and it will) then the cost of ObamaCare will skyrocket.
There will be less support for it then as it will go way above the so-called $980 billion dollars over 10 years that Dems say ObamaCare will cost - the threshold that Dems wanted to stay under.

Any unfunded mandates that total more than $50 million for states and $100 million for private businesses would be subject to a point of order debate & legislators would have to VOTE specifically that the benefit was worth the cost.
So, it looks like (I may be wrong) Democrats would have to debate and vote specifically that the benefit was worth the cost and they would then have to do one of two things:
Either 1.) fund the mandates imposed on the states and private businessesm, thus increasing the cost of ObamaCare way past $980 billion over the next 10 years or 2.) The money doesn’t go to the states and private businesses - thus shifting the costs elsewhere - to the federal level - and thus incresing the federal level cost of ObamaCare, sending it skyrocketing way past $980 billion over ten years.
Either way, the cost of Obamacare is going up, up, up.
I guess one of the mods is caught up in the letter of the law, rather than the spirit of it. Tis a shame...

There was an article about how much it will costs some states, that are already teetering on the brink of bankruptcy — this new law will bankrupt the Federal government and the states.
