I hope they have hired some very good bodyguards for themselves. What they are uncovering will lead to some that don’t want any more videos made.

May God keep them safe.

I don't think that this intrepid pair of (TRUE) journalists are on the road making these videos today. They did all this taping months, if not years ago, to get this story. It is only now, after they've collected all their evidence, that the are making it public, a little bit at a time, to counter any "bravo-sierra" rebuttal that ACORN would care to make.

This has been masterfully played by a pair of real journalists, doing the kind of work the SRM used to do, a long time ago...

In CA, this tapping violates Penal Code sec 632. It is alternatively a felony or misd. It also gives rise to a civil cause of action for violation of privacy. How do news organizations get away with this? - well, they don’t. See Lieberman v KCOP Television, 110 CA4th 156.

Of course, once a lawsuit or criminal action is filed, pre-trial discovery might yield fun tidbits about ACORN. ACORN would be best advised to leave this one alone.

lol this kid is deadly. Getting the first video out there and then letting the ACORN brass hang themselves with denials before unleashing the rest in a slow drip was pure genius. They turned a massive Dem grass roots org into a politically toxic joke with nothing but a camera and a ridiculous pimp costume.

I know for a fact that it was not years ago that the tapes were made since Obama was president at the time. The ACORN woman in LA said they were lobbying to pass Health Care wo that puts it no earlier that 01/09. Giles is only 20 now and O’Keefe is only 25 now. Why is it your thought that the taping could have been done “years ago”?

I hope you’re right and they are no longer doing this but there may be retribution because of the videos. You are totally right about the supposed MSM not doing their job. They haven’t been doing their job in years. What is sad is that the sheeple don’t realize they are getting fed only what they want them to know. 1984....

I don’t know..Liebernman involved Doctor patient..reasonable expectation of privacy, the question is did Acorn have a reasonable expectation of privacy in their office..have to see the layout door was open, could conversation be overhead etc..also if I recall correctly there is no reasonable expectation of privacy while discussing criminal activity as it goes against public policy..interesting to see what happens

Sec 632 includes “taping” of confidential conversations. Here the meetings were video-taped. The section is broader than wiretapping, hence the holding in Lieberman v RKO.

I have not done exhaustive research here - hardly - I just got bored preparing other cases and decided to look at Sec 632 to see if it applied. So far, I think it does.

You’re right - it’s a question of fact. I don’t know about the “crime” exception. The only exception I can think of off hand is for law enforcement.

I noticed that too and haven't heard any explanation of it anywhere.

Month and date appear right if it was done last month but the year is off.

In CA, this tapping violates Penal Code sec 632.

Most states (including New York) are one party consent states, meaning that it is legal to record a conversation as long as one party to the conversation (usually the person recording it) consents.

California and Maryland are two party consent states, meaning that both parties to a conversation have to consent.

The issue is the audio, not the video.

Here is a list showing which states are one party consent states and which states are two party consent states.

When recording liberals, it is best to avoid one party consent states, particularly when the state attorney generals are Democrats.

I'm betting that either Maryland or California will try to prosecute the journalists exposing ACORN, just like Maryland tried to prosecute Linda Tripp for exposing Bill Clinton.

It doesn't matter that no liberal would ever be prosecuted for running a similar sting operation on a conservative group. It doesn't even matter whether there is any possibility of a conviction. All that matters is making an example of anyone who dares try to expose a liberal.

We haven't heard everything, in fact only the tip of the iceberg. There's 48 hours worth of stuff that's been accumulated, and we've only seen what an hour, hour and a half come to public light yet.

This indicates to me two things. One that they are no longer making additional tapes, as their cover would have been blown with the publication of the first. The second, is that they spent quite some time gathering their evidence, so a year or two of criss-crossing the country, while posing as a pimp/prostitute pair at ACORN offices in locales nationwide, would be the most likely way they garnered their material.

This effort was not put together overnight, and it shows. I would not be at all surprised to learn they spent two years on this story...
