Obama may be a natural born citizen after all

Posted on 07/23/2009 8:07:18 PM PDT by DavidFarrar

I have spent time trying to make sense of the recent debate over Obama's Constitutional qualifications to be President of the United States and have recently come to the conclusion that Obama would be a "natural born" U.S. citizen if his father was Obama Sr., a British subject and Kenyan national at the time of his birth.

Unfortunately, we don't have sufficient corrorbative evidence to determine this issue. I wish we did.

As far as the adoption by Lolo Soetoro, I think due to Barry's age, it would be irrelevant as it pertains to Art. ll of the U.S. Constitution.

While everything you say is correct, rightly or wrongly, it is to the legal implications of these facts I have based my conclusion upon.

It is the defining law of the land at that time which determined citizenship for all future Americans citizens.

It could have just as easily have required all future American citizens to go through a process of earning their citizenship franchise through a period of servitude to the state.

Natural born to CITIZENS CAN MEAN NOTHING ELSE BUT BORN TO TWO US CITIZENS

Good find, but this only proves that someone paid someone to print something. Pretty weak. If you happen to run across something like oh say, a BIRTH CERTIFICATE, that would be useful.

I think you are wrong?

I think you are referring to the statutory meaning of "natural born", not the Constitutional meaning.

Please note, I am aware the Constitution has given Congress the authority to create naturalization laws. I am unaware of any authorization given to Congress by our Constitution that would allow it to change the Constitution itself.

I agree with everything you have stated. But, again, we must go to the main intent the framers had in authoring Art. ll, Section l, Clause 5 of the U.S. Constitution, and that was the "allegiance" the child would be subject to during its upbringing.

In this particular case, Barry's upbringing was not controlled by the father, but by the mother, or more precisely, by the mother's parents. There are gaps of course, as there may be in a lot of backgrounds, but on the whole, as far as the framers' intent goes, I think Barack Obama Jr., would be a "natural born" citizen. Although, given his background and the general lack of corroborative evidence, I think it is a fair question.

The term “natural born citizen” is not defined in the Constitution, leaving it and the naturalization process to be defined by law. Congress has done so.

Somewhere there is a story that says that BOTH hospitals in question DID NOT list any male births on Aug 4.

You need to review basic grammar. If a sentence reads “Children of mothers who used cocaine during pregnancy . . . “, this does not mean children who were born to two mothers. Likewise, the passage “children of citizens of the United States” does not say that each child had two parents who were citizens. If the writers had meant to specify both parents, they could easily have said so. But it’s immaterial as applied to Obama, because the whole sentence applies only to people born outside of the United States.

The established law at this point is that a baby born on US soil is a citizen (period).

A citizen, yes, but that child would not be a Natural Born Citizen.

You're as dense as the libs on this subject. No one's arguing what the law says about citizenship.

That is in no way correct. Children of illegal immigrants are natural-born US citizens.

Yes, it would a natural born citizen.

Then, we disagree. I'll go with the logic and reasoning of the Founders on the interpretation of what a natural born citizen is, thank you.

Congress has defined "natural born citizen" as it pertains to Art. ll, Sec. ll, Clause 5 of the U.S. Constitution?

Where?
