The Honorable Governor Palin had this to say about the latest media BS: inaccurate story floating around regarding ethics violation & Legal Defense Fund. The matter is still pending and new information was just requested. Their will be a final report.

Amanda Carpenter, of Human Events, responds to the Associated Press’s illegal and premature leak about Governor Palin and the most resent ethics complaint.

The Associated Press claims soon-to-be former Alaskan Governor Sarah Palin will be found guilty of violating her state's ethics rules, citing a report leaked to their offices from the State Personnel Board on one of the 19 ethics complaints filed against her.

I would love to see Palin in office as President the next time around. I don’t know how likely it is, but I’ll vote for her... :-)

However, don’t ever mention Romney, as that scumbag is the worst thing that could happen to us... don’t be fooled by Romney or the Romney-bots around here...

If there is anyone here who doesn’t understand why we cannot support a slick socialist politician like Mitt Romney, God help you, but you’re on the wrong website. We went through this with the abortionist, gay rights activist, illegal alien supporting, gun grabbing Rudy Giuliani until someone created another website call WAnkers for Rudy and they all flew the coop. Hopefully, before too much FReeper blood is shed, someone will create a WAnkers for Romney site and we can be left to fight the good fight as we see fit!

You never know where he honestly stands on any issue. What he promises today, he flips on tomorrow. It all depends on which way the political winds are blowing and which office he’s running for. He’s a liar.

He’s a big government socialist. His RomneyCare state run health care system is a big government boondoggle. It’s tyranny. Government provided, er, forced health care is tyranny not freedom or free markets. Do not believe the socialist propaganda supporting such nonsense.

Socialized medicine is simply another step to socialized government. Government solutions at the point of a gun are the opposite of what we need. This is socialism! Fascism! Mitt Romney is proud of his big government socialist creation and thinks it would be great for all of America. He wants to force you to accept what the state says is right for you. Your taxes will go up as government costs soar and the quality of the care you receive declines. High costs, long waits, rationing, poor or no service, big government force in other areas is where it leads.

If it wasn’t so maddening, it would be laughable. A legal defense fund was created to help her pay to defend herself against the frivolous ethics complaints (which the state AG declines to do) and the Rats have filed an ethics complaint about the LDF saying others assisting in paying for her defense is a “gift” and an ethics violation itself! As the governor says, no money has been distributed pending resolution so there has been no violation. The fact that Clinton and other senators have LDF’s for defense against real crimes is irrelevant to those with PDS.

BTW, the so called “independent” investigator is a member of the law firm that is defending Obama against no-real birth certificate charges as well as his campaign and those of a host of other Rats (Al Franken, WA state governor, etc.)

How can she be guilty of an ethics violation when others created and control the LDF and she has not received any money??

The answer is obvious; it’s not the resolution of the charge but the charge itself that drives those against her. Remember the Bush National Guard fake letter? There are those that still believe that particular letter may be a fake but that the charge was accurate. Same here; not the truth but the charge that matters to the Saul Alinsky radicals.

You are so right, there should be an uproar that the State Personnel Board leaked anything about an employee to the press. That is outrageous, reminds me of the idiot bureaucrats who ordered their staff to dig around in Joe The Plumber’s records. These people should lose their jobs at the least.

I’m talking about the State Personnel Board leaking information about her to the press. That sounds like an ethics violation on the part of the State’s Personnel Board.

Well, that lead “independent” investigator, Thomas Daniel, is a Democrat with the Perkins Coie law firm whose principals are associated with the Obama campaign and the Democratic party. Speculation is that he leaked it to the lady who filed the complaint, Kim Chatman, who in turn leaked it to the press. Either way he or a staff member is guilty of a violation of state law as such information is required to be confidential until the SPB resolves the matter.

In addition, my role as independent counsel for the personnel board is only to decide whether there is probable cause to believe a violation of the Ethics Act has occurred – not to reach a definitive conclusion. See AS 39.52.320. The ultimate determination of whether the governor has violated the Ethics Act can only be made by the personnel board after a formal heating and a report by the hearing officer. See AS 39.52.360-370.

In sum, I find probable cause to believe that payment of the governor’s legal fees by the Alaska Fund Trust will violate the Ethics Act prohibition against a public officer accepting gifts intended to influence performance of official duties.

I can recommend that corrective action be taken to resolve this complaint without the necessity of a formal hearing on the matter. See AS 39.52.330. My recommendation is that the governor should refuse to accept payment of her legal fees and costs from the Alaska Fund Trust and withdraw her authorization for the trust to be recognized as her “official” legal defense fund. I also recommend that she seek reimbursement from the state for the cost of defending the ethics complaints that have been dismissed.

I also recommend that the legislature consider amending the Ethics Act to require the state to reimburse a public official for reasonable legal fees and costs incurred to defend against an Ethics Act complaint that is dismissed. [emphasis added]

Did you get that? The independent investigator, Thomas Daniel, is not finding the governor in violation of the Ethics Act. Only the Personnel Board can make such a ruling, and Daniel actually recommends that no ruling is necessary. Gov. Palin has not accepted one dime of money from the legal defense fund yet. How can she be in violation of the Ethics Act for something she hasn’t even done yet? You can’t charge her with a violation for a future act! The language Daniel uses is future tense “will violate” — not violated.

Daniel recommends not accepting the funds and instead having the state pay for the legal bills incurred by the dismissed complaints (which is basically all of them). What poetic justice this is. Ordinary Americans from all over the country (and Alaska) gave money to pay these bills, but now the people of Alaska will be stiffed with the bill. Are Alaskans angry about these frivolous ethics complaints yet? Are you guys finally ready to take a stand? Enjoy paying for Andree McLeod’s hobby and obsession.

I’m not at all convinced that the Alaska Fund Trust will be forced to disband and return the money. I’m sure Gov. Palin’s attorney will counter this report. I’m sure it will be resolved. But if it does have to be disband and the money returned, then guess what? We’ll set up a new one for Sarah Palin as just a plain old citizen. And we’ll raise even more!

Congratulations once again to the nutters in Alaska who have turned the state’s Ethics Act into a joke. I sure hope that the Democrats up there fix the crazy loop holes in the Executive Branch Ethics Act before any Democrat is elected governor because anyone from anywhere can file an ethics complaint against the governor of Alaska without paying a penny, and there are a lot of people just itching for a tit for tat on this.
