SCOTUS released their opinion today on Ricci v. New Haven. They overturned the case in it's totality - Kennedy wrote it 5-4 decision. Here's Sotomayor's opinion. The SCOTUS opinion will be posted as soon as it becomes available. In part - "city's fear of litigation cannot justify the refusal to apply the test."

I think the dissenting decision is far more important to the country. How can intelligent people disagree? Oh...they are NOT intelligent. They are radical leftists!
Scary that it was 5-4. This should’ve been a judicial no-brainer. If the 4 dissenting justices gave a rat’s hairy hind end about the law.

does this mean the wise latina woman has been rejected by the other justices by a vote of 5-4? the senate WILL be looking at this because of her racist statements in the past. it looks to me like the supreme court just called the woman a racist.

I’m assuming Souter voted with the minority? Then Sotomayor wouldn’t have made any difference.
If our so-called journalists had an ounce of integrity, this would be examined thoroughly. Will not happen.

When I was listening to CBS Radio news this morning, they were already spinning the story expecting that Sotomayor would be upheld on Ricci. They explained, ever so patiently, that the new test would be designed so it better reflected “job performance”.
Obviously, the plan was for the objective criteria of “job performance” to be used as a racial correction factor, to guarantee the “proper” outcome.
Well, so much for that!
We already have a racist in the White House, no need for one on the Supreme Court.

We can just start calling her Soutermayor, let her take his place without any fuss, and go on pretty much like we have been for the last 2 years or so.

Oddly enough, putting this repulsive woman on the SC might be the least bad thing Obama could do. Her legal âscholarshipâ certainly doesn’t seem to have favorably impressed Justice Kennedy, who is the real decider in vital cases like this. Souter, OTOH, is reported to have been a good friend of Kennedy’s for about the last 20 years and, hence, a bad influence on Kennedy. Sotomayor, probably including enough repulsive body odor to make her a permanent advertisement for lifelong celibacy, along with a totally irritating personality, might well antagonize Kennedy so much that he would be far more inclined to rule with the originalist block on the Court. We can only hope.
No doubt she'll say that Latina wisdom was run over by the intransigence of five old white guys. Democrats are never lacking in excuses. </sarcasm>
