Impeachable Offense--the 5th Amendment and 'Government Motors'
Columbia Conservative Examiner ^ | June 7, 2009 | Anthony G. Martin

Posted on 06/06/2009 10:38:49 PM PDT by Welshman007

With the government-imposed terms of bankruptcy for GM and Chrysler, Barack Obama has violated the 5th Amendment to the U.S. Constitution--a serious impeachable offense. Bond holders and investors were deprived of due process of law and were not justly compensated for their investment. Instead, the UAW was given .68 cents on the dollar, although they never invested a dime in the companies, and the investors only received .28 cents on the dollar for their multi-millions they pumped into the 2 automakers.

IF Memory serves, did the impeachment proceeding for Clinton begin in the Senate?

No, impeachment articles must be brought by the House. The Senate votes on the articles. Either case takes a majority so that won't happen.

The Indiana State Treasurer is in the process of litigating this as regards to Chrysler. They have been granted at least one stay and extention, which (I'm not a legal person, so you might want to read for yourself) appears to be stalling the sale of any Chrysler assets. One of the arguments is a violation of the 5th amendment.

Furthermore, use of TARP funds in this manner was not authorized under the original TARP law and as such constitutes misappropriation of funds.

I applaud the Indiana State Treasurer...along with any other state officials standing strong against this tyranny!

This is premeditated theft by color of authority.

That is not politically correct. The accepted term is "authority of color".

Yes,,, there should be. Obama was not elected to rewrite the constitution. No President has the authority to just seize business, appoint Czars and all this other crap. Politicians will do whatever they think they can get away with. There ought to be a freaking massive lawsuit!! Something needs to be done. If I was one of these successful car dealers that just had been delivered a message that Obama was now going to seize their business,, I swear I would make them take me out in chains or burn the freaking dealership to the ground!!

And those “Republicans” are completely silent through all of this.

I AM NO LONGER A REPUBLICAN! I am ashamed to even associate myself with them these days, at a time when they could turn this around on a dime, they just play along like the good little career politicos that they are.

"...now what can we do about it?"

We have to vote out every RAT running for election or re-election in November of 2010.

Until then, there isn't really a damned thing we can do about it...except do what we can to drive the State-Run Media into bankruptcy.

Agree that is why poeple need to vote out the crooks and vote for someone who has a good track record and no hack should be able to serve no more than two terms so they don’t get into the good old boy club.

Welcome to 0bama’s ‘interpretive adjudication’; a new program that will be installed in the Supreme Court with the ascension of Sotomayor to that august body.

The law is what 0bama says it is, and it is subject to changing interpretations as the political landscape changes; as long as the interpretation furthers his arrogant, marxist plans.

It’s time to take back the country.

Can’t someone initiate some kind of legal action?

I'd like to peel the onion one layer deeper. We keep hearing ... "that is unconstitutional" (for many similar such activities) from many quarters ... and when you look at the grievance and the constitution ... sure enough, it is "unconstitutional." But if it is, why isn't the person or group doing it simply hauled off and put into jail or something? We all scream "unconstitutional" .. but what can we do about it, and what is anybody or group doing about it? My biggest fear is waking up to find the Constitution is just a set of "guidelines" now law. Maybe I just woke up?

I have a petition filed at the USSC right now, and the state was suppose to mail their objection, if they choose to file one, by last Wednesday. I’ll know by Tuesday if they actually filed one. If not, they must be hoping the USSC will simply not grant my petition for cert.

They can’t really object to anything in my petition because they know I have all the court records to prove what I stated in my petition. the constitutional violations were so blatant, the USSC can’t possibly decline cert.

The government acted in a manner in violation of the law, doing what it did because it IS the government. Definitely high crimes and misdemeanors.... Used its force and threat of punishment to push its way forward.... Ah, if we can take the house and Senate in 2010, I can’t wait.... The worst that could happen is we would end up with Joe Biden as president for two more years... Then Sarah in 2012...

...the investors only received .28 cents on the dollar for their multi-millions they pumped into the 2 automakers.

That is all part of the PLAN. For socialism to be initiated, capitalism must be destroyed. The way to destroy EEEVIL capitalism is to make the risks outwigh the rewards, so no one wants to invest.
