The question begs... What was the FAA doing on a porn site?

Possible defense: FAA member, without cause or authorization was viewing porn sites on a government computer, within a government building and on government paid time.

Defense seeks to suppress the evidence as the agent discovered said evidence in a place he had no legal authority to be, while in violation of the agents employers written policy and in violation of the law.

Therefore, the illegally obtained discovery by the agent, requires the suppression of the evidence and all subsequent evidence as fruits of the poisonous tree.

Unless of course the agent wants to admit an inadvertent discovery made while he was away from work, on his own time and looking at porn for his own personal ‘reasons’.
