Supreme Court To Review Obama’s Citizenship

It looks like the Barack Obama citizenship issue will not die until he is inaugurated. It probably will not end even then.

Now the U.S. Supreme Court will discuss the matter in private because one justice decided it was worthy. Before fingering the member of our highest court, I will give a little background information on the case. If you do not think too hard about it, you can probably guess which Supreme Court Justice is responsible.

Leo Donofrio of New Jersey filed suit against Nina Wells, the New Jersey Secretary of State, claiming that she had not performed her duty to ensure the integrity of the electoral process.

Donofrio originally asked a state court to review the citizenship of Barack Obama, John McCain and Roger Calero. Calero was the Socialist Worker’s Party Presidential candidate. He was born in Venezuela. That is a cut and dry case.

John McCain was born in Panama but on an American military base. Legal scholars believe birth on an American military base qualifies as a “natural-born citizen.”  A “natural-born citizen” is one of the requirements to be President.

For Obama, it is the old born in Kenya story again. Anyone who doubts that Obama was not born in Hawaii, please refer to Politifact and Factcheck investigations. Hawaii does not allow birth records to be publicly viewed. This is why no one can go in and see the certificate. It is not because Obama is hiding them, or they were never there. Anyway, after Donofrio’s case was rejected at the state level, he presented it to Supreme Court Justice David Souter who rejected it. Donofrio then presented it to Supreme Court Justice Clarence Thomas who put it on the court docket for a conference on December 5. If four of the nine justices decide to hear the case, then full oral arguments will be scheduled.

Now it is possible Thomas wants to review Calero’s eligibility as a Presidential candidate. There are plenty of acceptable reasons for this. However, the timing, 10 days before the Electoral College meets, only gives hope and ammunition for those who believe Barack Obama has conspired to create the greatest hoax in world history — that he and his family have been hiding his Kenyan citizenship since he was a few days old so he could run for President.

Gee, thanks, Clarence Thomas.

By the way, for those still questioning Obama’s and McCain’s citizenship qualifications, al-Qaeda did fly planes into the Twin Towers, aliens have not abducted millions of people for medical experiments, and the moon is not made of cheese.

Having read Congressman Billybob’s post above—I’m convinced that he has given constructive criticism to Donofrio and the other 16 or so suits. Does anyone know a way to forward Billybob’s comments to Donofrio and the other 16

I really have no earthly idea how this would be handled.

I feel confident enough to say this is an easy call. The answer is it won't be handled at all.

Unless you count name calling and demonizing as even further "fringe wacko involvement" handling it. Our recent history is crystal clear on this one.

Here is another example of a stupidity that knows no bounds: “Hawaii does not allow birth records to be publicly viewed. This is why no one can go in and see the certificate. It is not because Obama is hiding them, or they were never there.”
The implication here is that Obama is prohibited by the State of Hawaii from allowing anyone to “publicly view” his birth certificate.

This guy needs to stop beating himself in the head with the stupid stick.

The conservative talking heads (Rush, Hannity, etc.) won’t touch this because they are affraid of being tagged as “racist”

The MSM won’t touch this because ^they don’t want to know^...as long as a black has been elected...and the US is not a racist culture anymore and the world loves us...etc, etc.

Problem is, Justice Thomas will need to make the (i) the argument, (ii) the decision and (iii) the public announcement simply because he is THE black Justice (and he doesn’t like nor chase-after the public light).

I think we must pray for Justice Thomas in these very trying times. Pray that he does the right thing in service to his country.

Wouldn't it be ironic "if" the justice he sought to keep off the SCOTUS is the one who catapults Biden into the Presidency he has wanted for a very long time.

Yes, Justice Thomas will do the right thing and I am not sure many Freepers will be happy with Justice Thomas after he does the "right thing."

Well, yes. I voted for him twice. Once in 2000 for POTUS and then again in 2004 for ILL Senator.

Amb. Keyes is a great conservative mind and a well spoken Constitutionalist. Congruently, he is too easily manipulated by the MSM as a “finge, right-wing kook”. It isn’t his fault, but more the fault of ^how^ he gets the constructionist message out. The message is easily twisted by the MSM to make him appear the “kook”.

I do hope that Amb. Keyes court case in Cally gets good play but, being filed in the Cal-Dist court, I don’t see it coming to much.

I will agree with J. Thomas if he can support his decision from the constitution and not from the “popular will of the people”.

If that (popular will) is the basis of his decision, he is simply deferriing to the “we don’t want no riots” crowd of the country-club Pubbies.

For some reason, I don’t think J. Thomas will follow that line.

Obama himself couldn’t release his birth certificate, which is utter nonsense. Of course he could and the question is, why isn’t he.

The bigger question is "Why would he choose to pay major $$$ to lawyers, rather than release it?"

That’s the problem. And it’s why pursuing this issue with respect to President-elect Obama is a waste of time. The biggest problem isn’t the “natural born citizen” definition (though that is somewhat vague), but the standard of proof. Beyond reasonable doubt? Preponderance of the evidence? Does information provided by foreign governments trump information provided by US federal or state governments? These details should be worked out in a piece legislation to be effective going forward, so it will have plenty of time to go through any legal challenges. But as for Barack Obama, he’s going to President for the next 4 years, and we shouldn’t be distracted by this side issue.
