Barack Obama claims “particularly serious embarrassment will result from turning over the requested documentation” in the Berg case and has filed a request for dismissal and a protective order. Berg’s filing asks for copies of his birth certificate, citizenship records, passport and travel records, and other documentation proving citizenship in the U.S. as well as other countries.
First, let’s establish that I am no lawyer so don’t depend on my interpretation of the Berg vs. Obama lawsuit as being accurate. I am depending on the interpretations of others who know much more than I, and assuming they have it right. With that out of the way, let’s proceed.
Philip Berg (a Democrat and former deputy attorney general of the state of Pennsylvania) filed his initial lawsuit against Barack Obama August 21, 2008 in Philadelphia Federal Court, claiming Obama is constitutionally ineligible to be President based on citizenship. The first counter filing was from Obama only, but the DNC has since joined in.
Barack Obama and the DNC failed to respond to Berg’s filing of Sep. 15 within the required 30 days, which means they ADMITTED to all the charges in the filing by default. When they did not respond in any manner to any of the requests for information or documention the judge extended their deadline, and they then filed a motion for DISMISSAL and for a PROTECTIVE ORDER.
Their reasoning for requesting a protective order is that revealing the information (birth certificate, passports, citizenship in other countries) would “cause a defined and serious injury” to Obama and/or the DNC. They say revealing these documents raises a “legitimate privacy concern” and the above mentioned risk that “particularly serious embarrassment will result from turning over the requested documentation.” (emphasis added) Then they claim Berg has no standing to ask for it.
* Is it just me, or does this sound like an admission of guilt? If his birth certificate and citizenship records, including passports and travel documentation, are going to cause “particularly serious embarrassment,” can we assume they do not prove he is a natural born citizen as required by the Constitution for eligibility for the presidency? How else could they be embarrassing? * Obama has already posted a copy of his birth certificate online (deemed by some experts to be a poor forgery), so wouldn’t this have nullified any expectation for privacy?
From the list of 83 charges filed and not rebutted, here are some they admitted to (remember, they technically “admitted” them because they didn’t refute them):
1. Barack Obama is not a natural born U.S. citizen 2. Barack Obama was born in Mombasa, Kenya 3. Barack Obama traveled to Pakistan with friends in 1981 on an Indonesian passport 4. Barack Obama has asked others to have his birth certificate in Hawaii altered 5. The DNC has knowledge of this and is complicit in hiding it
WHERE IS THE MAIN STREAM MEDIA? With speculation that he was born in Kenya, is still a citizen of Indonesia, traveled to Pakistan on an Indonesian passport, and never re-claimed his American citizenship, does anyone doubt if this were the Republican candidate they would be spending at least as much time investigating it as they did Joe the Plumber’s background? It would be all over the news 24 hours a day! But Obama? They don’t investigate, they don’t report. Where is their journalistic integrity?
Berg now has filed:
A) A motion requesting an immediate order deeming his request for admissions served upon Barack Obama and the DNC on September 15 admitted by default, and
B) A motion requesting an expedited ruling and/or hearing on Berg’s motion deeming the request for admissions served upon Obama and the DNC admitted.
If Judge Surrick grants these motions, Barack Obama is, at least temporarily, ineligible to run for the office of President of the United States OR to be a citizen of the United States.
There are some rumblings from the courthouse that a ruling, one way or the other, may be forthcoming by the end of this week.

What more could Berg have done? Unless he has an actual Kenyan birth certificate, or somehow got a copy of The One's Hawaiian long form (vault) BC or Obama would have voluntarily supplied a copy, he has to get a court order to get one from the state of Hawaii.
Nah, that would help with a major 'Rat core constituency.
I think Frank Marshall Davis is the father on the hidden birth certificate. Communist. ...that is the secret. There are no photos of “Obama Jr” with “Obama Sr” other than one photo taken at an airport. Could be Barack Senior and Frank Davis were good pals thus the pic with little Barry. The real Barack Obama dies in 1982 and little Barry Davis takes his name, thus getting rid of the Communist dad’s name and record. No wonder we are not allowed to see Columbia and Oxy records...they are probably in the last name of Davis or Soetoro. Getting rid of the evidence...How did he ever get a security clearance if this is the true story? People in the military have to jump hurdles to get clearances...but we could have a presidential candidate that has maybe been hiding his whole life from us. Is this what the half hour special will be about next week since he knows he has or will be caught? A sad saga of his life? Gross dishonesty would be more like it if my little theory is true. It is even deeper than that. Diana Feinstein, CA, Dean, Pelosi and all the Secretaries of States in the Union are involved. They all have a responsibility to oversee that an eligible candidate is on all States ballots!!!

If his parents were married under Kenyan law, and he was born in Kenya, he's a Kenyan, and therefore not eligible to be POTUS.
If his parents weren't married under US law, and he was born in Kenya, he's an American, and therefore although a bastard, he'd be an AMERICAN bastard.
Both can be true at the same time.
Worse, just being an American doesn't necessarily qualify him as a "natural born citizen" if he was born off shore under jus soli, HOWEVER, if one (some interpretations) or both parents are US citizens he is qualified under jus sanguinis

I still think that this could be as simple as Barak Obama being simply Barry Dunham....think about it. If Barry CHOSE his name Barak Hussien Obama rather than being given it, what does it suggest?????

In NJ, in order to get a DRIVERs LICENSE you MUST show a certified birth certificate. If you have changed your name, you must show the paper work to prove it. How is it that this man has not had to show his birth cert to show he is eligible AND what his real name is????

Athough, not knowing the lawyerees, I can't tell if they just wish have themselves dropped as a defendent. However it does allege that Berg has no standing to challenge the eligibility of a Canidate for President, and that they, the FEC, has no oversight of the Constiution's eligibility clause.
If that were true, the obvious questions are "Who would have such standing", and "what person or agency has the responsibility to see that the Constitution is obeyed, if not the FEC?"
In their request for dismall, Obama and the DNC assert that the Court has no jurisdiction over Art. II requirements. Again, then who does? (Of course they would feel differently about Amendment 15 requirements and Amendment 24 requirements. )
I think he looks more like Davis.
How in the world does Obama get away with not presenting his birth certificate, his medical records, or his donor list? Why in the world do we have requirements to run for President if they don’t enforce it?
