Barack Obama claims “particularly serious embarrassment will result from turning over the requested documentation” in the Berg case and has filed a request for dismissal and a protective order. Berg’s filing asks for copies of his birth certificate, citizenship records, passport and travel records, and other documentation proving citizenship in the U.S. as well as other countries.
First, let’s establish that I am no lawyer so don’t depend on my interpretation of the Berg vs. Obama lawsuit as being accurate. I am depending on the interpretations of others who know much more than I, and assuming they have it right. With that out of the way, let’s proceed.
Philip Berg (a Democrat and former deputy attorney general of the state of Pennsylvania) filed his initial lawsuit against Barack Obama August 21, 2008 in Philadelphia Federal Court, claiming Obama is constitutionally ineligible to be President based on citizenship. The first counter filing was from Obama only, but the DNC has since joined in.
Barack Obama and the DNC failed to respond to Berg’s filing of Sep. 15 within the required 30 days, which means they ADMITTED to all the charges in the filing by default. When they did not respond in any manner to any of the requests for information or documention the judge extended their deadline, and they then filed a motion for DISMISSAL and for a PROTECTIVE ORDER.
Their reasoning for requesting a protective order is that revealing the information (birth certificate, passports, citizenship in other countries) would “cause a defined and serious injury” to Obama and/or the DNC. They say revealing these documents raises a “legitimate privacy concern” and the above mentioned risk that “particularly serious embarrassment will result from turning over the requested documentation.” (emphasis added) Then they claim Berg has no standing to ask for it.
* Is it just me, or does this sound like an admission of guilt? If his birth certificate and citizenship records, including passports and travel documentation, are going to cause “particularly serious embarrassment,” can we assume they do not prove he is a natural born citizen as required by the Constitution for eligibility for the presidency? How else could they be embarrassing? * Obama has already posted a copy of his birth certificate online (deemed by some experts to be a poor forgery), so wouldn’t this have nullified any expectation for privacy?
From the list of 83 charges filed and not rebutted, here are some they admitted to (remember, they technically “admitted” them because they didn’t refute them):
1. Barack Obama is not a natural born U.S. citizen 2. Barack Obama was born in Mombasa, Kenya 3. Barack Obama traveled to Pakistan with friends in 1981 on an Indonesian passport 4. Barack Obama has asked others to have his birth certificate in Hawaii altered 5. The DNC has knowledge of this and is complicit in hiding it
WHERE IS THE MAIN STREAM MEDIA? With speculation that he was born in Kenya, is still a citizen of Indonesia, traveled to Pakistan on an Indonesian passport, and never re-claimed his American citizenship, does anyone doubt if this were the Republican candidate they would be spending at least as much time investigating it as they did Joe the Plumber’s background? It would be all over the news 24 hours a day! But Obama? They don’t investigate, they don’t report. Where is their journalistic integrity?
Berg now has filed:
A) A motion requesting an immediate order deeming his request for admissions served upon Barack Obama and the DNC on September 15 admitted by default, and
B) A motion requesting an expedited ruling and/or hearing on Berg’s motion deeming the request for admissions served upon Obama and the DNC admitted.
If Judge Surrick grants these motions, Barack Obama is, at least temporarily, ineligible to run for the office of President of the United States OR to be a citizen of the United States.
There are some rumblings from the courthouse that a ruling, one way or the other, may be forthcoming by the end of this week.

I knew of a family (didn't know them personally, but someone that I worked with did know them well) that became Muslim, and the father legally changed his name and the names of all the children to Muslim names. We've seen lots of sports figures do it, too.
After all the denials from Barry Dunham of never having been Muslim, a name change after adulthood would demonstrate what a liar he is. So what else is he hiding?
Nope, under the law prevailing at the time of his birth, his mother was too young to confer automatic citizenship on BHO if he was born outside the US, regardless of her marital status vis-a-vis the father. If he was born in Kenya he is not Constitutionally eligible to be POTUS.
Which of the documents in there, specifically, mention the “serious embarrassment” wording? I’m not seeing it. Does that wording come from Berg or the Obama camp? .......
I’m not a lawyer so the best I can do is:
It comes from the Obama Camp
It is probably document 12 motion to dismiss or document 15 protective request.
It may be in referencing other cases that the terminology comes out.
Or maybe the middle name is really Steve.
Even if he is a bona fide bastard, that’s no big deal. We all know plenty of people who were born in similar circumstances.
Of course, his bastardy may not be an accident of birth. He could be a self-made man.

Hi. Yeah, I’ve been lurking on these threads and following along more or less. What I really don’t get is why a presidential candidate - any presidential candidate, going back to the early years of the nation - doesn’t have to prove to somebody or other, or some government agency or other - that he actually fulfills the constitutional requirements.
I suppose it’s because, thinking back on it, the issue has never come up before. I mean, Herbert Hoover, FDR, Truman, Ike, JFK, LBJ, RMN, Ford, Carter, Dutch, both Bushes and Bubba... they all had a very obvious paper trail going back to childhood. But, still, the mechanism should be in place on the government side, so that a private citizen doesn’t have to bother with this sort of lawsuit.
Do you see what I’m saying? I mean, why hasn’t the judiciary or congress jumped in on this? Don’t candidates have to file all sorts of papers and so on?

What is interesting to note is that Christians and U.S.
citizens were prohibitted from entering Pakistan during this time!!!

Pakistan was in a turmoil during 70's & 80's because of dictatorship and the Afghanistan war.
In 1981 Pakistan was under Martial Law for fifth straight year. The entire country was under Sharia Islamic Law.
Pakistan was on the banned travel list for US Citizens at the time and all non-Muslim visitors were not welcome unless sponsored by their embassy for official business.
There would be only a few reasons a young Westerner of the Muslim faith would travel to Pakistan in 1981:
To Participate in Jihad, which is the duty of every ‘True Believer‘.
A quick check shows that in Illinois, no BC is required unless you are under 18.

Apparently not. One would think so, but I don't think a candidate about whom there was any question has ever refused to provide such proof. Not that there have been many. There certainly haven't been any with a foreign father, a mother still a teenager, who lived for several of his formative years in a foreign country with a foreign stepfather, and who magically was able to travel to a foreign country, which was not allowing anything but "official" travel into the country by Americans. Well you get the picture.
The requirement to be natural born was put in there to avoid potential foreign loyalties and influences upon the President. The Anointed One certainly has such influence, gobs and gobs of it. When it was written, it would have virtually impossible for the son of Foreign citizen *father* to be a natural born citizen, unless he was born on US soil, and in some situations, not even then.
