The bottom line is that we got Roberts and Alito through the Senate, even though we had only a razor-thin majority and a number of Rino senators. McCain’s ploy was designed to prevent the nuclear option while breaking the deadlock in the filibustering Senate. It worked.

We might have mixed feelings about whether or not the nuclear option should have been used, but we did get Roberts and Alito through the Senate confirmation process.
The nuke option would not have passed...too many republican senators didn’t want to give up the ability to filibuster.
But McCain and Frist conspired to make it seem like it would be used....and they succeeded in getting 2 Supremes confirmed.
People are compromising on FR too much for their own good. Are they in for some surprises if Scarface gets the Presidency. But...but....but...WE thought he would be CONSERVATIVE!!

If you will recall from that time, it takes 61 Senators to prevent a filibuster. Therefore, 55 Senators was inconsequential in terms of confirming a judge.
In terms of the Nuclear Option, the plan that I saw would have required a simple majority, 51 Senators, to support. Since there were 55 Republicans, it could have passed. However, there were some of those Republicans who did not want to agree to a new senate rule that would have prevented them some day from filibustering judicial selections by a democratic president.
While I understood that, I disagreed with it. I think the spirit of the Constitution calls for the Senate to hold an up or down vote on presidential selections.
The only reason Roberts and Alito made it through was that they were replacing conservatives. We would need a conservative President AND at least 60% of the Senate to push through a conservative replacement for any of the far left liberals on the Court. That's why I expect that the best we will do with McCain are moderate-liberals like Anthony Kennedy.
Unfortunately, the opposite does not hold true. Democrats have never had any problem pushing ultra left wing nominees through. Ginsburg and Breyer were confirmed with only token opposition. If Obama is President there is no doubt that every judicial nomination that he makes will be as liberal or more liberal than Ginsburg and Breyer.
You and your group of McCain apologists are the only bogus conservatives here. McCain said Pelosi is a hero. I guess she’s your hero too.
