Osvaldo Aldrete-Davila, the drug smuggler who testified for the prosecution during the trials for Border Patrol Agents Ignacio Ramos and Jose Compean, has been arrested on charges of bringing more than 750 pounds of marijuana into the United States.
Aldrete-Davila was arrested today at the El Paso border crossing on charges involving what has become know as the "second load," in which he smuggled a second 750-pound load of marijuana into the U.S. after he was given immunity by the prosecutor, U.S. Attorney Johnny Sutton, for the first load.

I hope that this helps them and that the US attorney can’t twist this in some way to screw them.

He said that they proved today that Sutton was lying all along...
The sealed indictment was unsealed...proved Sutton was not still investigating the smuggler..it was ievidence that thedre was ongoing drtug smuggling and nothing to do with the BP...it shpould have been used in their trial...

First, I was wrong in suspecting that the reason Davis wasn’t being pursued was that they didn’t have any evidence.
I was wrong because in fact the case WAS on going, and he has now been charged with the crime that people have been insisting he was given immunity for.
Sutton has now done what he promised all along, to find a way to prosecute this man for a crime.
We will all be happy to see him in prison.
The ruling in the R/C case was that a 2nd drug bust was immaterial and inadmissable. It is clear that the reason the information was kept under wraps was that it WAS in fact an ongoing investigation, something others kept insisting was NOT the case.
It would be nice if they put one of the threads in breaking news. This is a big story.
Should probably close this one out.

How does an arrest show he wasn’t still pursuing a case? Doesn’t an arrest show he WAS pursuing a case?
Doesn’t having him arrested in fact prove that the claims that he was given immunity for the “2nd load” was false? Doesn’t it prove that the claims that Sutton was refusing to prosecute him for the 2nd load was false? Doesn’t it prove that in fact there WAS an ongoing case and that it has now come to the point where the man is being arrested?
Why would I be happy to see the prosecuter in prison? I’ll be happy to see the drug smuggler in prison, as Sutton always said he hoped to accomplish (and people said he would never do so because he had given the guy immunity).

Iwo Jima surmised that the AUSA’s may present a weak case that lets him walk.
I think that makes sense as then Sutton can say “See—we told you, we needed more evidence.” Hopefully the DEA has some pretty compelling evidence to present that they won’t be able to bury and they really want to put this guy in jail.
Yeah, forever. The only reason they had to come clean was because all the pressure that was put on them. There is no such thing as a massive two year multi-department investigation over a little drug mule. They had him on sentences that carry 40 year jail terms on two different occasions. Are you saying they wanted more?
