A Technical Point May Sealed the Fate of the Senate Immigration Bill

There is a interesting point that was made by a local radio program. That the Senate bill has a loophole that has the potential cause their bill to implode.

As we know, the Senate passed the Comprehensive Illegal Reform Act(CIRA) several weeks ago in the U.S. Senate. Contained in that bill was a provision that mandated that illegal immigrants to pay back taxes. Well the Senate made a mistake when they passed that amedment. According to Article One, Section Seven of the U.S. Constitution, "All bills for raising revenue shall originate in the House of Represenatives; but the Senate may propose or concur with Amendmentments as on the other bills." According to this the U.S. Senate does not have the authority to have illegal immigrants to pay back taxes. Only the House of Representatives can order illegal immigrants to order back taxes. That provision is not in HR4437, passed by the House. The United States Senate in their hurry to pass a bill, violated the Constitution when it mandated that illigal immigrants pay back taxes. In Federalist 66, Alexander Hamilton writes "The exclusive privilge of originating money bills will belong to the House of Represenatives." I do not know if the House has reminded the Senate whether they cannot have this provision in the bill because House has the power to raise revenue.If a major provision of the Senate bill is gone, I think that it will fall apart.
Does this technical point have the power for CIRA to implode?

Its a technical problem that will implode their bill. It is like a small hole in the window pane of a spacecraft. Do they have staffers that assist them when it comes to constitutional matters?

I cannot believe that they would pass something with a technical point with nobody noticing. Then they have a gall to say to the public(with a straight face) that they will force illegal immigrants to pay taxes when they do not have the constitutional authourity to do so. That point can sink their legislation. I do have to agree with you.

Hmmm....if they're so careless and incompentent as to let the taxation initiated by the senate get by, what else in the bill is unconstitutional?
These boobs are paid about $200,000 a year with only one performance review every 6 years...we need to make sure that the rinos and rats voting for this worthless bill are thrown out of office.

Well if the Senate bill gets shot down on a technicality, no big deal in my mind. It's clear that the House Leadership are the only one's with their heads on straight right now about the importance of improving immigration security and protecting the border.

You bring up a very good point. This is an excellent mission for the Heritage Foundation to go through the bill and find more hidden loopholes in the bill. If there is one loophole in the bill, there must be many loopholes than need to be exposed and dissimated to the public.
