A welcome change to the supreme court.

Posted on 01/26/2006 5:22:59 PM PST by Arcy

Only days separate Sam Alito from being confirmed as the next Supreme Court Justice. (YEA!) Many years ago a nominee of his caliber, with his knowledge and respect for the constitution and the rule of law, would have been graciously welcomed by both sides. In today’s political climate however, the very thought of his presence on the court has one side of the political arm so seething mad, they're beside themselves. Why?

You see, for decades the majority of members on the court reflected a corrupt understanding of the founder’s intent. This led to numerous misinterpretations of the law and countless injustices to those who looked to the court to right wrongs. This "intellectually wounded" state of the court has often been exploited by those on the left to push through a political agenda that could never have been passed through normal legislative procedures.

This once often abused path is about to be closed when Sam Alito takes his seat on the court. And that is what has those on the left approaching insanity.

In politically contentious times like this, it's good to check on your political foes. I just came back from the bleacher seats over at the left wind coliseum. They're practically eating each other alive over there. Condemning each other and demanding that each one call his/her senator. A few try to instill calm but most have turned to typist savagery reflecting the true state of affairs...utter hysteria! As for me, its time for another bag of popcorn and back to the seats! The good guy always wins! Doesn't if feel great?

Let's get Alito on the bench and all pray for the next resignation to be quick, hopefully Stevens!!!!!

John Paul Stevens, appointed to the Supreme Court in 1975, is the oldest member of the current Court and, behind Chief Justice Rehnquist, the second-longest serving. Nominated by Republican President Gerald Ford in the wake of the Watergate scandal to help re-establish public confidence in government, Stevens was widely viewed as a moderate, concerned more with the details of a given case than a broad and predictable judicial philosophy. As the Court moved to the right during the Reagan and Bush administrations, however, Stevens began to ally more often with the liberal bloc. He has voted to uphold Roe v. Wade and a woman's right to abortion, for example, and has resisted the Federalism doctrine that is one of the most notable characteristics of the Rehnquist Court.

As the senior member of the liberal wing, Stevens often controls the assignment of opinions in closely-decided cases. Still, his influence remains uncertain. Many observers point to his quirky and unconventional jurisprudence as a constraint on his ability to lead the Court. They argue that Stevens' individualistic personality keeps him permanently outside the mainstream of the Court and that he lacks the characteristics of a coalition-builder. Nevertheless, in light of the Court's close ideological split and Stevens remarkable intelligence and experience, it would be difficult to discount his role in determining the Court's direction.

I hope Stevens will show some allegiance to Republicans and resign, but I doubt it. He intends to die on the bench, like Rehnquist.
