DEATH OF THE AMERICAN SOUL - (Terri Schaivo's ordeal; tyranny of judicial system)
DA;LEY TIMES-POST ^ | MARCH 28, 2005 | SHER ZIEVE

Posted on 03/27/2005 5:20:26 PM PST by CHARLITE

At some point, perhaps in the not too distant future, the Terri Schiavo case may prove to be the seminal event that sparked the final days of the once-respected and essential soul of America. That which makes the Terri Schiavo case and controversy unique is neither that she has been on feeding and hydration tubes, nor that they were removed so that she would finally and inexorably die. Rather, it is that we, as a nation, have been intimately involved in the death watch and a media event…that of the murder of an innocent woman.

I have heard estimates that between 25,000-35,000 American citizens are being kept alive, via feeding tubes, in US hospitals and hospices. However, unlike others in Terri Schiavo’s condition, Terri was not given an opportunity to, again, even attempt to swallow. She was not even allowed ice chips. She was condemned to death with no chance of a pardon. But, even these Hitlerian techniques are not the worst of what has happened.

This is an execution to which our entire country, nee the world, has been privy; if not part and parcel. The mainstream media have even been taking votes on it! For example, “If you were in a persistent vegetative state, would you want to continue living?” Another priceless poll question was: “If you were brain dead, would you want to continue in that state or would you choose to die?” A major problem with these questions is that there are still medical experts who say that Terri was neither in a ‘vegetative state’ or ‘brain dead’. But, the mainstream media didn’t and doesn’t care.

This is another prime, if perverted, example of ‘anything for ratings’ and to push their agenda. Those queried, we were told, gave answers overwhelmingly in favor of death. The problem, of course, was that the people voting are still alive and functional. However, quite reminiscent of ancient mobs in the Roman Circus Maximus gladiatorial games, those questioned gave a “thumbs’ down”. But, they were voting for Terri’s death…not theirs. The blood lust is running high.

Apart from the horrific death Terri Schiavo has been left to experience and the pain and suffering of her family, the Schindlers, is what has happened to us. Those who have called for her death and have become increasingly irritated that she hasn’t yet died, are furious that anyone would have the gall to try to help her live. The justification some of them have used is “she wouldn’t want to live that way.’ How do they know? Further, how do they know Terri’s true capabilities? She was denied all therapy. None of us know. One posting, in response to an open letter from Terri’s father read: “Urgent message from God: I want Terri up here with me in paradise! Stop hanging on down there! How many ways do I have to tell you? 19 judges, 2 appeals courts, supreme courts, etc., etc., etc.” Yes. The blood lust continues.

Perhaps, the worst thing that has happened is that we as a people have been given a current glimpse, in real time, of our collective soul. It is not a pretty picture. In their Declaration of Independence from England, the founders of our country clearly and unambiguously expressed that it was our right, as citizens, to life, liberty and the pursuit of happiness. Terri is our new and shining example that we no longer believe in it; at least not for those we deem disabled.

I wonder how long it will be before we start labeling people as to whether or not their lives should be allowed to continue. With the Terri Schiavo case we have begun our entry into the brave new world of deciding which groups will live and which will die. Hitler began with his extermination of the infirmed, continued through the mentally ill and ended with his attempt at genocide of the Jews. He almost accomplished it. Stalin starved to death between 20MM-30MM of his own people. Will technology allow us to complete group-euthanasia faster and more efficiently?

It has been said that the first murder is the hardest and that each additional is easier than the last. As the prurient blood lust continues, I fear that the death of the American soul will not be far behind.

When will "WE THE PEOPLE" be outraged enough to force a reform of this skewed-to-the-left judicial system?

Sadly,it is an accurate portrayal of the situation.
I am surprised by the defeaning silence of the organisations that care for the disabled. Do they not hear the footsteps?.

In every stage of these Oppressions we have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince, whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people.

Declaration of Independence.

I guess when it's our turn to watch a loved one killed at the whim of a diabolical spouse and complicit judiciary.

Many disabled groups did speak up but the Mainstream Propagandists did not allow them to be heard.

Thanks for posting this thought-provoking article.

I know that Judge Greer was elected, not appointed, but still...

It's all
about
the judges.

Frankly Ihave seen them make more fuss over the lack of a ramp at a mall or a theater. This is going to be a much harder battle for them to fight now that the precedent has been created.
Felos was already citing Bush vs Schiavo ,and SChindkers vs Schiavo yesterday and she is not evev dead.

I talked to some residents of Pinellas Park when I was down there yesterday, and they told me that Judge Greer was reelected basically because he never discussed the Schiavo case and his part in it, judges don't really have to campaign and explain their decisions or their record, and most people vote for whoever is in office (or don't vote for the judges at all, because they don't know anything about them).

Judges are elected only in the technical sense of the word. If they are really to be elected, they should be out there running, there should be more than one candidate, they should declare a party, and they should be questioned and put to public scrutiny just like any other candidate. But they are not, because judicial "campaigns"- in Florida, at least - are stealth campaigns where nothing is known about the candidate and most people don't vote for that slot anyway simply because they know nothing about the candidates.

there are still medical experts who say that Terri was neither in a ‘vegetative state’ or ‘brain dead’

I've heard this claim a number of times, but nobody has ever presented these experts or their analysis. Considering that every court which has heard the case thus far has found that Terri Schiavo was indeed in a persistent vegetative state, I'd say the burden of proof is on those claiming the opposite is true.

Anyone who has been caught in the swirling hell of domestic relations court can tell you that there is nothing new here. "Welcome to the party pal."

From Sherrie Gossett's blog on A.I.M.org.

http://www.aim.org/sherrie_blog#/2812_0_18_0/

"March 27, 2005 Jeb's role vis-a-vis Terri Schiavo Florida Governor Jeb Bush has been taking a lot of heat from evangelicals who insist he is able to save Terri. He's already been called "Pontius Pilate." I asked a friend who is a lawyer about this. His response in part:

"I would expect that the Schindlers have already raised the state constitutional angle. It is not a bad argument as a matter of political philosophy. But ever since Marbury vs. Madison, we have been traveling down a path leading to judicial supremacy.

This is the philosophy of Legal Realism, or the view that the law is what the courts say it is. So while I agree that Governor Bush may have a legal right under the Florida constitution to protect Terri as a handicapped person, Sekulow is right that as a lawyer I can't advise Bush to violate a court order.

What good would it do to violate the court order? Judge Greer would freak out, and he would try to issue some court order to have Terri returned to the hospice. Assuming Terri would be in custody of Jeb and the xyz Department for handicapped persons, what can Jeb do? He is in charge of the executive Branch...law enforcement. He can order the police to keep people away from Terri.

But the problem is that the cops would begin asking themselves where their authority lies...and whether they were in danger of being found in contempt of court by obeying a renegade Governor. Jeb would have to have the support of every cop in the state, otherwise some cop may arrest the Governor."

Posted by: Sherrie on Mar 27, 05 | 7:16 pm | Permalink

......and I just heard Rush Limbaugh say that if Jeb Bush were to override Greer's order NOT to intervene to save Terri, then theoretically, any Governor could intervene at any time into a case where he disagreed with the court's findings.

When I listened to Rush Friday, he gave me the impression his opinion was the opposite on whether or not the executive branch could take action, from the opinion he is expressing today.

The greater risk in my view, is the precedent TERRI'S CASE will establish. Instead of the ASSUMPTION of LIFE when there is conflicting HEARSAY testimony, and NO LIVING WILL there will be an assumption of death. And it will have other negative ramifications in these cases as well.

I do not AGREE the that the Authorities in this case who took action to save Terri's life (including JEB BUSH) is correctly analogous to PONTIUS PILATE who took NO ACTION to save Christ's life, but more like a HOT POTATO that was passed from one branch of government to the other. The ARROGANCE and TYRRANEY of the ROGUE JUDGES who THWARTED Congress, the Constitution and the law in this matter, have the last say and will be allowed to STAND and TERRI WILL DIE!

THAT reality is the greatest DANGER in this entire Scenario.

The BUSHES have missed a GREAT opportunity to stand up to the TYRANEY Of the JUDICIAL BRANCH and put the COURTS back in their place.
