Subject: KERRY DISCHARGE - THE JIMMY CARTER LEGACY CONTINUES

Words of Captain Donald L. Nelson, JAG corps USN ret I was on active duty as a U.S. Navy JAG when all of this was going on 25 to 30 years ago, and so was Mark F. Sullivan, who at all relevant times was the personal JAG to J. William Middendorf, then the Secretary of the Navy.

We are trying to break this absolutely true story nationwide, i.e., Fox News, C-Span, and hopefully the major networks. We are positive that John Kerry was one of those dishonorably dismissed from the Navy for collaborating with the Viet Cong after he was released from active duty but still in the Navy and for a totally unauthorized trip to Hanoi. He later got an "honorable" separation in 1978, some 12 years after joining the Navy, under President Carter's "Amnesty Program" for draft dodgers, deserters, and other malcontents who fled to Canada and Holland, among other places, to avoid military service to our country.

This is why he has refused, and continues to refuse, to release all of his Navy records: they reflect that he was Dishonorably Dismissed from the United States Naval Service. If they do not (which they do) he would have released them to the public. Again, he has not done so, because he well knows that the truth would kill his challenge to President Bush. It disgusted me at the time. It still disgusts me today.

I would like to know Senator Kerry's answers to these questions. I would be very displeased to know that he was hiding this information from the citizens of the United Sates, intentionally, just so he could "play President".

I was unaware of the timing here- and had forgotten Carter's amnesty program til this reminder. If this turns out to be true and accurate.............Holy S@%T!!!!!!!

But if there were those behind the scenes who have known this all along...how could this have been kept under wraps throughout this entire election season??? God knows there are plenty of FBI and CIA agents willing to sell the president out- though Porter Goss will shortly change part of that equation...

I am scared to death that if Kerry wins the election (by voter fraud) the press whom I would be surprised to learn doesn't know about this, will TELL us once it's too late because they will want to prove once and for all how powerful they are and how powerless the citizenry is. I don't think there's anything that could be done to change the outcome if this $%#^&*($%%#$ has been pardoned.

I'm a retired Army officer. It was always my understanding that a dishonorable discharge could be adjudged only by a general court martial after conviction. Since Kerry was never court-martialed, how could he have received a DD? Could not have. A JAGC officer surely knows this! If Kerry received a discharge that was later upgraded, it could have been a General Discharge of a Discharge Under Other Than Honorable Conditions, I suppose. Absent a court martial, these discharges, or an Honorable Discharge, are the only ones an officer may receive absent judicial proceedings. They are not the same as a DD. Precise language is important in talking about these things. But I await really convincing evidence of this claim. At any rate, the news will not affect the election even if it is true.

I just spoke with Mark. They are putting together a couple more pieces and actively working on this story. Let's hope it is breaking big. Drudge will lead the way and force people to talk about it.

Several of us contacted Mr. Sullivan when Mr. Nelson's E-Mail first broke. Mr. Sulllivan replied that he was working soley with Thomas Lipscomb on this subject.

Yes, Mark had told me that but I didn't know if he wanted me to mention it. I look for Lipscomb to be on Drudge. He should be on shows all day long on Monday.

I also saw a thread yesterday from someone who contacted Lipscomb, and he said that he did not yet have the info that NavyChief was talking about.

I would like to know Senator Kerry's answers to these questions.

Asked, and answered recently on a TV interview.

Kerry said, "I do not know how they would come up with that, as My records are NOT public."

The statement was in response to a question about his IQ tests, but the answer would be the same in every case.

Thanks. I knew he was discharged under the Carter "pardon legislation", I simply wasn't aware of any details. Someone is going to break the facts soon.

I have not seen anyone saying specifically that the discharge was Dishonorable.

I believe the gist of it is a General, or a General under less that honorable conditions.

My guess is a General.

Kerry never went to Hanoi. At least not while the VN war was still going on.

I'm sure they meant Paris. But it is kind of sloppy for a JAG to write such things.

This JAG has also claimed elsewhere that Carter's EO pardoning draft evaders would have helped Kerry. Of course it would not have been relevant to Kerry's case.
