I want to know who was the military brass that ultimately approved this. Probably some careerist dickhead who couldn't get a promotion any other way.
Wait. What about the discharge that was issued in 1978 at the pleasure of President Carter? It says it was honorable. I do not, however, think it was a Naval Discharge. I think it was a general honorable discharge.
The media is totally SILENT on Kerry's military records, aren't they? Not a PEEP!Bush signed the standard form 180 to release his military records, but Kerry has NOT. Yet he's TELLING everyone that he HAS released them.

Carter's pardon only applied to violations of the Selective Service Act.
No, he gave him a discharge under Title 10 US Code 1162 which is at the pleasure of the President and may have been just for Kerry. You think? Maybe?

Maybe there is a difference in active reserve and inactive reserve. Anyway, If Kerry has nothing to hide I see no reason why he shouldn't release his military records. He's hiding something.

This is a long shot, granted, but he may have violated a Navy Reg, been subject to court-martial under UCMJ, and been granted a discharge rather than face trial..
Personally, I think the prior post is more likely..
He was simply discharged at his request, to go into politics..
President Carter would have probably known Kerry's intentions, and political aspirations, and Leftist leanings..
Just the sort of young officer the President and the DNC would want, running for office..

1) Kerry received an honorable discharge on 2/16/78
2) Kerry's officer candidate agreement dated 2/18/66 does not adamantly "require" a Ready Reserve schedule of 48 drills or 17 days service per annum. You will note the following clause "or other appropriate Reserve training as may be authorized." If because of post-VN drawdowns Kerry was not called to Reserve duty, then there's no there, there.
3) The Naval Reserve Manpower Center in Bainbridge was a records and personnel administration center for USNR. It was not an active command post where people reported for Reserve duty.
4) The UCMJ applies to reservists only while undergoing reserve training, UCMJ 802.2(a)(3) "Members of a reserve component while on inactive-duty training."
5) Lt. John Kerry's letter of 21 Nov. 1969 ... falsely states "My current regular period of obligated service would be completed in December of this year." This is not a false statement. Kerry's officer candidate agreement of 2/18/1966 establishes that his service period begins from the day of commission. Kerry was commissioned as a USNR Ensign on 12/16/66. His three-year active term thus concludes on 12/16/1969.
There are several other errors, but I don't have time to list them at the moment. Will be happy to followup later.
Is it legal for a person in the military to also serve as a senator? If Kerry had not been formally separated until 2001, does that create a problem?
