How significant was an EU ruling on same-sex marriage?

Last Tuesday, the European Union’s top court ordered Poland to recognize the marriage of a same-sex couple who had wed in Germany.

In delivering its verdict, the Court of Justice of the European Union (CJEU) kept the language broad, referring to the obligation of “a member state” to recognize same-sex marriages registered in other EU member states.

It means that a Czech, Romanian or Bulgarian court — or any other EU member state where same-sex marriage is not recognized — will now have to take the verdict into consideration if a similar case arises in their jurisdiction.

The case in question involved a married Polish couple, Jakub Cupriak-Trojan and Mateusz Trojan, who tied the knot in Berlin in 2018 while residing in Germany.

When they returned to live in Poland the following year, they tried to register their marriage at Warsaw’s civil registry office. However, that request was declined on the basis that Polish law recognizes marriage as a union between a man and a woman. […]

In issuing its verdict this week, the court found that the refusal of Polish authorities to recognize the marriage could not be justified as it breached EU law on safeguarding “respect for private and family life”.

Polish authorities, the court found, had left the couple “in a legal limbo” and had failed to meet the “fundamental needs of recognition and protection of same-sex couples in a stable relationship”. …

Yes; the EUSSR still hasn’t gotten out of Britain in spite of “Brexit”. Both Labour and the Tories are their vanguard there, with the Lib-Dems and even the “king” as minor cheerleaders.

Poland, like most European countries, follows Roman law, so the CJEU has no "precedence" because there isn't any such notion under Roman law. Polish courts would have to argue that the CJEU ruling establishes new law, a rather dicey argument under Polish law, especially since the Polish courts have already ruled that the Polish Constitution limits their authority to enforce EU regulations.

Without enabling legislation in Poland, this ruling probably isn't doing much.

And Nawrocki would probably veto any such legislation, even if it could garner a majority in the Polish parliament.

It was Polish individuals, Poland would marry them. Germany should have respected that and not married them. Respect only flows one way.

Europe has progressed from a customs union to a trade union, to a nanny state where there’s a rule and regulation for every little thing. I suspect that soon all men, by law, must pee sitting down under penalty of fines. Enforcement will be by monitoring cameras.

Poland currently recognizes marriage as only between a man and a woman.

Those are clauses two and three of the preamble of the Treaty of Rome, which established the so-called European Economic Community (commonly called the “Common Market”) in 1957. And they had it planned even further back than that. The communistic and imperialistic principles are evident even back then.

Germany themselves legalized “same-sex marriage” back in 2017.

And Germany runs the EUSSR, so they regard EUSSR law and their law as one and the same to be imposed on all the other EUSSR member states.

My point was two countries have different laws on same sex marriage. The no gay marriage country always have to give way to the other.

This is an example of why the EU treaties should NOT have created a central EU court over the sovereignty of the EU nations on any matter. All matters should be handled not by majority rules, nor by “independent” agencies or courts, but, like NATO, by consensus only - meaning the individual governments of all the EU states agree. Everything else is an element that is starting to and will pull the EU apart.

Since the impetus of the EUSSR is “ever-closer union among the peoples of Europe”, of course they would have created a central court over every other EUSSR member state.

Remember, the treaties are patterned after the charter of the UN, which in turn was patterned after the 1936 USSR constitution.
