A transgender woman is suing a Hooters franchise for discrimination after they allegedly refused to hire her based on 'her image'.
Brandy Livingston has been a regular at the restaurant, on Wolf Road in Colonie, a suburb of Albany in New York.
With career aspirations of working for the chain, Livingston had applied three times.
Livingston said she was not respected as a woman at the establishment, alleging that workers actively discriminated against her.
She told the outlet: 'They would use male pronouns. They would refer to me as he.'
On her being denied employment, she added: 'I said, do you want to see my experience or anything? Because I had previous jobs I had written down.
'And he said, “Oh, we don’t care about experience. We hire on the basis of personality. And there’s an image that needs to be met".'
Livingston said that she had also heard employees and a manager at the restaurant harass her about using their restroom.
She claimed: 'I overheard one of the servers after I left the restroom talking to one of the managers and said that, "Why are you allowing him in the women’s restroom?"
'And the manager said, "Oh, I don’t like it any more than you do".'
Livingston filed a claim with the New York State Division of Human Rights who investigated, and found evidence her rights may have been violated.
Hooters has since hit back at the claims, saying that Livingston had been told not to return to the establishment over alleged offensive behavior.
Their lawyers said that Livingston allegedly made sexually explicit comments to servers on multiple occasions prior to her transitioning.
News10 reporter James De La Fuente questioned Livingston over this, saying the chain had accused her asking servers to marry her, and discussing masturbation.

Like I would really want to see what someone like that looks like in the uniform complete with the short shorts and pantyhose, etc.

I did this so my fellow FReepers wouldn’t have to: no, there is no picture of him in pantyhose but there is a picture of a guy who looks like he plays center for his high school football team. Couldn’t fit in any Hooter’s uniform known to mankind.
No, they refused to hire HIM. Plus, people go to Hooters for the wings and breasts, not the hot dogs.
A “handicap” is one thing; serious mental illness and delusional behavior in conjunction with being under the influence of powerful hormone-changing drugs is altogether “something else” ... and a potentially serious risk exposure to a commercial business.
It ain’t a “her”.
Nuisance lawsuits can be put to an end with loser-pays settlements. Put he burden on the cheap lawyers.

SENATOR BRAD HOYLMAN-SIGAL September 10, 2024 ISSUE: CIVIL RIGHTS GENDER DISCRIMINATION GENDER EQUALITY ABORTION
When you vote this November, please remember to flip over your ballot and vote on Proposal 1, also known as the Equal Rights Amendment.
This proposal amends Article 1, Section 11 of the New York Constitution. Section 11 now protects against unequal treatment based on race, color, creed, and religion. The proposal will amend the act to also protect against unequal treatment based on ethnicity, national origin, age, disability, sex, sexual orientation, gender identity, gender expression, pregnancy, and pregnancy outcomes, as well as reproductive healthcare and autonomy. The amendment allows laws to prevent or undo past discrimination.
When voting on this proposal you can choose between two options:
“YES” vote puts these protections in the New York State Constitution.
“NO” vote leaves these protections out of the State Constitution.

Concurrent Resolution of the Senate and Assembly proposing an amendment to section 11 of article 1 of the constitution, in relation to equal protection
Section 1. Resolved (if the Assembly concur), That section 11 of article 1 of the constitution be amended to read as follows:
§ 11. a. No person shall be denied the equal protection of the laws of this state or any subdivision thereof. No person shall, because of race, color, ethnicity, national origin, age, disability, creed [or], religion, or sex, including sexual orientation, gender identity, gender expression, pregnancy, pregnancy outcomes, and reproductive healthcare and autonomy, be subjected to any discrimination in [his or her] their civil rights by any other person or by any firm, corporation, or institution, or by the state or any agency or subdivision of the state, pursuant to law.
b. Nothing in this section shall invalidate or prevent the adoption of any law, regulation, program, or practice that is designed to prevent or dismantle discrimination on the basis of a characteristic listed in this section, nor shall any characteristic listed in this section be interpreted to interfere with, limit, or deny the civil rights of any person based upon any other characteristic identified in this section.
§ 2. Resolved (if the Assembly concur), That the foregoing amendment be submitted to the people for approval at the general election to be held in the year 2024 in accordance with the provisions of the election law.
Explanation – Matter in underscored is new; matter in brackets [ ] is old law to be omitted.
I thought places like this specifically hired “models” and NOT wait staff in order to completely avoid these issues.
Squarely between the extremes.
If Hooters loses this suit and is forced to hire...it and others like it then they might as well close the doors ‘cause there is NO WAY I’m buying another chicken wing from them ever, I won’t go near the place.
This is the trans version of the wedding cake incident. They go there specifically looking for a lawsuit.
