He swerved and flipped a wrangler. Easy to do. Maybe someone “special” sabotaged the brakes on this special loaner vehicle.

My first thought as well. But why involve a big company with deep pockets and a need to prove you faked it? Pretty stupid. But, then, he’s a Hollywood type and, on average, they come across as astonishingly unconnected with how the real world works. Bakes, for example only fail when the script requires it. That’s why present day movies are so bad. Stuff happens not because the story set it up to be inevitable, but because that’s what the director wanted. So just write it in. We’ll fix it in the editing room.
First rule of a roadway deer encounter: hit the deer, don’t swerve to try to miss it. Sorry but that’s the way it is.
I think if I was on the jury, he’d have to prove that that particular Jeep had brake problems.

He picked the wrong vehicle that’s for sure. Because of the sheer nature of what jeeps are designed to do (go off road and climb hills etc.) Braking is critical.
When’s the last time you heard of a vehicle having brake failure?
That’s the MAIN safety system on any vehicle.
I suspect if this even happened at all he panicked and hit the accelerator by mistake.
From what little research I did there are no brake related recalls on that year/model jeep.
Sure he swerved to avoid a deer.
And who’s going to prove otherwise?
