During a hearing in U.S. District Court Monday, an attorney for an Army officer fighting deployment to Iraq questioned Barack Obama’s legal right to serve as president, asserting he was born in Kenya, not Hawaii.

Judge Clay Land, inquisitive throughout the 90-minute hearing, said he will issue a decision on Capt. Connie Rhodes’ request for a temporary restraining order by noon Wednesday.

Rhodes was represented by Orly Taitz, a California lawyer and a national figure in the “birther” movement that claims Obama does not meet the qualifications to be president.

California attorney Orly Taitz, the president of the Defend Our Freedoms Foundation, stands on the steps of the Columbus federal courthouse Friday with what she claims is a copy of a birth certificate for President Barack Obama from Mombass, British Protectorate of Kenya.

Maj. Rebecca Ausprung, with the Department of the Army, Litigation Division in Washington, told Land this case was about Rhodes, not Obama.

“There was a lack of any reference to Capt. Rhodes,” Ausprung said. “This case is about Capt. Rhodes and her deployment.”

Taitz kept going back to Obama’s birth certificate. Twice she called Obama a “usurper.”

Your point is well-taken. But note that the Constitution lists requirements to be President, Senator, and Representative but does not explicitly require candidates for these offices to prove that they are qualified.

As I understand civil and criminal jurisprudence in this country, the plaintiff always has the burden of proof. So I agree with the judge here.

I also agree with the judge's complaint about Taitz's grandstanding. Calling Obama a 'usurper?' He may be, but does conduct like that have a place in any court of law? Taitz may get headlines, but she doesn't get results for her client, which is what an attorney is supposed to do.

Orly is a colorful character out of a novel. Who gets their law degree on line and passes the bar? Who would run from court to court and not give up once she latched onto an injustice like this and ridiculed by every corner of power in the US. She does not look like a proper lawyer and she does not act like a proper lawyer. Still, I respect the heck out of her for her gumption and tenacity in life - in this case and in general. She is such an underdog and she is making the big dogs squeal. That is freedom in action.

It is alright to laugh about Orly. All that matters is who gets the last laugh. I am pulling for Orly.

Another avenue has opened up as well. Obamafiles.com reports that the SOS in New Hampshire is investigating NBC now. I believe she was set off by the DNC altering the ballot form to remove the line about constitutional qualification for the Kenyan.

According to Obamafiles.com, the SOS in New Hampshire is now investigating the form alteration and falseification. Someone is going to laugh last and it might be Orly indirectly. If not for her, the scam would have never seen the light of day.

Hasn’t precedent already been set by the Army(?not sure which branch it was) already rescinding another soldiers orders based on the same complaint?

You'll notice that they didn't rescind Captain Rhodes' orders. She's supposed to report for deployment right about now.
