A local Ft. Collins man was charged with sexual assault and "domestic violence harrassment" after his wife complained to police that on numerous occasions in the past year she awoke at night to find him "having sex or oral sex" even though she had told him this seemed like rape to her. The husband also admitted to taking nude photos of her while she slept.

You are exactly right. I thought about writing why I believe that in relation to this article based on personal experience but considering some of the people on this thread, I reconsidered.

"I bet this wife was just ticked off that the husband couldn't tell the difference."
Haha. Your Honor, I was asleep, dreaming about the girl down by the pool and when I woke up I found out I was with my wife. It was a terrible let down, Sir.

If he was gettin' busy and she didn't even wake up, he was doing something very incorrectly.
That's not fair ... maybe she's a sound sleeper. Or maybe he's doing it correctly but just under-equipped for the job. ;-)

You're rather ignorant of religions, aren't you? In TN, it was legal to beat your wife once a year on the court house steps. Do you know where the phrase "rule of thumb" came from? The stick could be no larger in diameter than your thumb. No Islam involved. Judeo/Christian.

I'm guessing there is something more to the story. Like he posted nekkid pictures of her on the internet. Or something more sordid.

Sharing a bed with someone in a marriage relationship is an indication that you've agreed to have sex with them.

While I agree with you in principle, but the statement is incomplete, add "at a time when it is mutually agreed on".
But, hey, I'm happy for all you guys who have wives who simply submit to every one of your expressed sexual whims. I'll bet there are a lot more of you on anonymous internet forums than there are in real life.

ROFLOL....yeah, he is pretty much a frog about his wording. From years of being controlled by his wife I presume. LOL

I agree with you in principle as well....but the way you worded the mutually agreed part is what destroys the marriages. Paul did not word it that way because of the issues it will present....
He worded it as ceasing "mutually agreed upon". Big difference as I read it.
Defraud ye not one the other, except it be with consent for a time, that ye may give yourselves to fasting and prayer; and come together again, that Satan tempt you not for your incontinency.

The dictionary I'm looking at doesn't exclude married women from the definition of rape when the perp is her husband.
That made me laugh. Is there a point to that?
Using your own logic, since she doesn't want to have sex with him, he can divorce her.
My logic? Legally, either can divorce each other at will.
I fail to see in the marriage vows of any recognized religion that marriage means never getting turned down again, and that should it happen, you can take it anyway, at any time, under any circumstances.
I was speaking of secular law, but if you want to get into ancient Middle Eastern traditions look up the whole "wives submit to your husbands" stuff in the bible and Koran. But I wasn't talkng religion, purely legally.
Some of you sound like you don't want wives, you want anatomically correct blow up dolls.
Yeah, it's apparent that that is the depth of your understanding.
