So we have those who say "she was asleep", those who say "he killed her first" and those who say "we don't know", but he did. But from almost day one, the Van Dams covered how Danielle might not have woken up when she was carried out of the house saying "she may have thought it was her father carrying her"..
I say, if he didn't do it, then we have to consider all the other possible suspects, and they all originate from inside that home..unless she walked out, which Damon and Brenda covered from day one, saying "she sleep-walked". The Van Dams seemed to be one step ahead of things.
But in Duseks opening statement to the Jury, he promised that he would show how Westerfield took this child and how he murdered her. We wait.

Right. The standard is "more prejudicial than probative." In other words, would it inflame the passions of the jury, and provide little else in relation to finding the truth of the case? You know, like all those horrible porn videos that they tortured the jury with?
I hate to say it but it could very well be that they didn't want anyone to break and run before they could get something on them.
Why they were not at least followed or matched for fingerprints or the DNA found in DVD's room I have no idea. Usually what you see is if the person is on probation or parol they can hold them for a possible violation and ask them questions, that I belive might have been a good idea for some.
Argh, sorry, I don't have that info at my fingertips! We were discussing in on the threads a few days (or about a week?) back. I remember the discussion about the lack of testing of the van. Can anyone help out here?

Well until someone starts asking some pretty tough questions I don't think we'll even hear about the POSSIBILITY of there being any other suspect than DW I mean, he's CREEPY, and all remember?
I did catch Samantha's mom on CNN this am and it was heart breaking. She also said however that she had heard the DA in Avila's prior case saying that he was going to have a hard time dealing with the fact that Avila was aquitted.
She said she told him he had done everything in his power to try to bring the man to justice and didn't blame him.
She then said, "I blame every member of the jury that belived this murderer of children over those two girls." And "all you have to do in California is belive the child but they didn't and they let him out on the streets."
She said it with so much hatred in her voice I was slightly startled before realizing that was greif and the pain of her loss that spoke. I really hate those so-called journalists who have the need to shove a microphone into a persons face who has just suffered a terrible loss. They capitalize on their grief and pain, it is emotional rape of the worst kind.
OK! I can't take it any longer.
