Nick Sortor @nicksortor 🚨 BREAKING EXCLUSIVE: Ohio mental hospital CONFIRMS James Talarico was discharged from the facility earlier this week

The “flu” thing was a BIG FAT LIE

Following reporting by @SaraGonzalesTX and @CarolineWren , a hospital employee told @RheinAmacher and I that Talarico had in fact been a patient at the Lindner Center of Hope near Cincinnati, Ohio, which specializes in around-the-clock mental health treatment.

While I sympathize with those dealing with mental health crises, this man is CLEARLY not suited to become a US Senator representing over 30 MILLION TEXANS.

The job doesn’t get easier after being elected — it only gets MORE stressful.

And Talarico clearly can’t handle it.

I pray he gets the help he needs, but Texans need a real representative they can rely on.

It’s not an opt in.
It’s an opt out.

If the patient does not object after being informed, the limited directory information can be shared with callers/visitors who ask by name.

Someone was sloppy.

It is very hard to believe that the source of a leak won’t be identified and the leaker terminated in 48 hours (only because it’s a weekend, 24 hours is normal).

The catch-22 is that terminating the leaker in 48 hours confirms the story.

“You knew what I meant”

Ya think? One of my duties in HR was to teach the godforsaken HIPAA training. My boss didn’t like my attitude. Me? Attitude?

I wonder how he knew to talk to somebody at that particular facility

Someone probably contacted him and requested confidentiality.

Yes, I've been discussing this recently on a thread… The communists have had to be very circumspect since Senator Joseph McCarthy outed them as far back as the early 50s.

We owe Senator McCarthy a debt of gratitude, because he made communism disreputable to Americans in general. He does not get the credit for that that he deserves, in my opinion. Before McCarthy, youthful dalliances with communism were seen as simply an indiscretion and nothing more. After McCarthy it was seen as shameful. And that was good.

Since then, communists have been required to take a measured and patient approach through the 60s 70s, and even the 80s. But when Bill Clinton became president, all that caution went out the window (or at least the cultural shame we felt should be applied to communists) the communists began to emerge from the woodwork and venture out into the open.

Bill Clinton should've been bad enough, but then Obama?

Yes, in the 70s and 80s, those 60s radicals cut their hair and put on suits, entering the halls of power themselves that no longer had the will or desire to exclude them from it. They worked their way up the ladders of power until they actually had their hands on real power.

And then, within the last couple of election cycles they began to increase in boldness.

With Obama's presidency just about over, and Hillary Clinton looking like she was going to take over, things seemed pretty rosy for the left.

But then, Trump happened.

He pushed the right buttons to wake people up as to where we were, and what was needed to at least slow, if not halt that slide to the abyss. There were a lot of people in this country who needed to hear somebody say things like:

"Having open borders is national suicide."

"Climate Change is a Hoax."

"Leftists have weaponized government."

And last but not least, at his 2026 State of The Union speech, which to me, ranks up there with Churchill's "Finest Hour" speech! (Only semi-kidding!):

I’m pretty sure they broke the law if that is true.

It had been rumored based on private plane departures and landings.

He called and asked to speak to James Talarico. They told him he’d already checked out.

That is my understanding.

If true, it is good tradecraft.

One of my duties in HR was to teach the godforsaken HIPAA training.

So what happens now?

The catch-22 is that terminating the employee confirms the story.

Can they terminate the employee with an NDA that prevents the person from saying they were terminated? Would that be a condition of avoiding prosecution?

Or is the person free to say they were terminated without giving an explanation as to why? What would such a person be free to say when they apply for a job somewhere else and has to put their employment history on the application? I worked at Lindner Center of Hope in Cincinnati, Ohio from xxx to October, 2026?

Huge hipaa violation, but it’s good to know.

Not a HIPAA violation to simply disclose that Talarico was seen at medical treatment facility as long as the disclosure does not include protected health information such as the specific medical issue or treatment. For example, an employee of the facility could state -- without violating HIPAA -- that he saw Talarico at the facility in late September/early October as long as the employee does not disclose that he received treatment for a specific disease or the specific treatment that he received. The employee -- if identified -- might still get fired for breach of the employee code of conduct, but not for violating HIPAA.

I don’t even know the rules any more, since I retired 20 years ago. (HIPAA was relatively new when I was forced to teach it to city ees in 2002.) I’m sure much has changed in 20 years. (I wonder if it actually made a positive difference in people’s lives.)

In this case, acknowledging admission to a mental health facility is a HIPAA violation without a doubt.

It may be a hippa violation from the employee, but it revealed no medical info.

Not a HIPAA violation unless the source disclosed protected health information, i.e., specific medical issue, diagnosis, treatment, etc. Merely stating that Talarico is no longer at the facility is not a HIPAA violation.

“Actually, the investigator skirted the edge of HIPAA:

Under the HIPAA facility directory rules (45 CFR § 164.510(a)), a hospital may disclose certain limited information to someone who asks for a patient by name, if the patient has not opted out of the directory. Official HHS guidance specifically allows releasing the fact that a patient has been “treated and released” (or is no longer at the facility) as part of that directory information. It is treated as reflecting the patient’s location (no longer in the facility) and general condition.”

Absolutely correct. As long as the health care provider does not disclose the specific health issue, diagnosis or treatment, no HIPAA violation.

The correct answer to the question, in any hospital, is, “I’m sorry, we have no information regarding anyone by that name” once someone has been discharged.

That’s for hospitals where people have appendicitis and heart attacks.

For hospitals where the fact of an admission or outpatient treatment is PHI by definition, the conditions are more stringent.

What they could say, if he had checked out, is that there is no one there by that name. Likely, in a situation like a mental hospital is that there is a list of who calls may be received from. Anyone else will be told they can not provide or confirm any patient info. Since it is a mental hospital, the patients probably are not getting a lot of calls.

"Bill is the first black President because he's a sinner and always in trouble"

Ha! I forgot all about that! Obama wasn’t actually our first (half) black president!

Obama was the third “black” president.

Jimmy Carter was hailed as the “first black president”.

Bill Clinton was hailed as the “first black president”.

Obama was at least the third president gifted with that appellation.

STOP. It is NOT a violation of HIPPA to verify if someone is an inpatient or has been an inpatient in a hospital. If you want to be on ‘Absolutely No Publicity’ status then you or your family must request it, then fill out a paper form and sign it. I have had to do this.

If you hear your friend or family member is in the hospital, do you actually think you can’t just call and ask for John Smith’s room?

Sloppy of Talarico’s handlers to not opt out.

_____

Exactly! That is the important point - his handlers are incompetent. Everyone in Hollywood and DC knows about this. The other important point is not his mental issues, Demons love that because they are all sick, but he just proved himself a LIAR. You don’t get to be a flagrant liar during the campaign.
