President Donald Trump's ban on CNN, MS NOW and Politico suffered a setback Thursday after a federal judge ordered the administration to restore White House access to the outlets.
U.S. District Judge Timothy Kelly issued a temporary restraining order Thursday blocking the ban and ordering White House officials to "immediately return, reinstate, and restore" the outlets' hard-pass press credentials while their legal battle continues. The order will be in effect for 14 days.
Kelly wrote that the outlets had shown they were likely to succeed on their claim that their White House "hard passes were revoked without constitutionally adequate due process."
"This is a high bar, but Plaintiffs have met it," Kelly wrote of the standard for obtaining a temporary restraining order.
Kelly also rejected, at least for now, the administration's national security justification, writing that "the record lacks factual support" for the contention that revoking the passes protected national security or that restoring them would endanger it.
Trump announced the ban last week, writing on social media that the three outlets "shouldn't be able to constantly write or report FICTION and LIES."
Lawyers for the Justice Department argued that White House press access is a privilege, not a right, and defended the president's authority to determine who receives access.
Following Trump's ban, White House television pool members FOX News Media, ABC News, CBS News, CNN and NBC News announced Monday that they had agreed to suspend their pooled coverage of the president.

Is there a press room at Guantanamo they can use?
I think the White House should remove all the seating in the pressroom and make the press stand the entire time. Then DJT should send officials down often to hold long press conferences.
It’s a relatively small room, but removing the seating would enable the WH to allow more news agencies to attend the briefings. If they consider it a right for the news agencies to attend, then throw the doors open and just pack ‘em in.
Then when the outcry about standing becomes too much, replace the seating but put back individual unupholstered, wooden, 1950’s government issued desk chairs with about 1/2” removed from one leg. If they can’t give balanced news let’s see if they can balance while sitting.
Of course the Administration should show their environmentally sensitive side and raise the AC by a few degrees. Let them experience some climate change.

Time to embarrass the judge. Let them in. Just don’t call on them or answer “no comment” to their shouted questions. Love to see Politico go back to court whining “Donald let me in the house and now he won’t talk to me” This moron judge that Trump appointed to the DC Court will then be put in the embarrassing ludicrous position of telling a President who he must call on and the extent of the information he is to provide them.
I don’t believe the Black Robed tyrants have any say over National Security Issues as recognized by the President.
And there is no Constitutional provision for a White House Press Office.
Common Sense says this should take about three minutes at SCOTUS.

If I suddenly declare myself a reporter then should I not be allowed access by law? The fact is that the space is limited. Not everyone can attend. Who determines what individuals and organizations get to attend. The constitution says nothing about that. If CNN attends then that means someone else can’t.
An affidavit is a written statement of facts confirmed by oath or affirmation, signed voluntarily, and made before a notary public or authorized official. It carries the same legal weight as testifying orally in a courtroom.
Make them sign one did you ever report misinformation?.
