They need to file charges at the state level. No pardon there.

Rand has a lot of back-up on that committee. Ron Johnson, Hawley and Moreno from Ohio were superb before I turned it off they all condemned Fauci so it looks like the votes are there for contempt at least.

The fifth doesnt apply in international criminal court.
Nor does his pardon.

Bad precedent to set imho. The international criminal court has no say here. OUR courts should be doing their freaking jobs. Our judiciary is out of control and our legislative branch is feckless.

Once you plead The 5th, you cannot answer any questions or you can be held in contempt when you plead again.
Fauci LIED before the committee today!
He swore to tell the truth whole truth and nothing but the truth.
THEN he did not. Chose instead to plead 5th.
I don’t see how he can swear in, swear to tell the whole truth and then not.
If he wanted to invoke 5th, He should have invoked it prior to swearing to tell the whole truth.
The fact of his invoking The Fifth after a pardon should automatically and necessarily undo the pardon (irrespective of the autopen issue).
The problem is Biden couldn’t pardon him for state crimes. And the open possibility of ANY prosecution, even if unlikely to occur, is still grounds to plead the fifth. See, e.g. U.S. v. Miranti, 253 F.2d 135, 139-140 (2d Cir. 1958). The Second Circuit ended its opinion in that case remarking that “the Constitution is for the despicable as well as for the admirable.”
