Pointing a gun at someone is a very dangerous act. This looks like a clear case of justified self defense.

A bystander sensibly kicks the weapon out of the reach of the bad guy on the ground and HE gets charged with “tampering with evidence”?
To: marktwain
In addition to the shooting, authorities said a 45-year-old man stood over the victim as he lay on the ground, took videos and pictures of him, then kicked his gun near some trash cans. That man is now in custody and being charged with tampering with a crime scene.Perhaps the man on the ground was reaching for his gun? They do it all the time on TV and in the movies. The prudent thing to do would be to kick the gun towards some trash cans.

Who does that ? Oh, cool, this should be good for a couple of clicks.
Sounds like some gangland stunt. Send a picture of the deceased to his momma. They do that sort of chit.
