A 2023 Idaho bathroom bill is now permanently in effect statewide following the dismissal of a lawsuit challenging the anti-trans legislation.
Attorneys for the Sexuality and Gender Alliance, a student group at Boise High School, and the state agreed to dismiss the lawsuit in federal court on Wednesday following the death of one plaintiff and the high-school graduation of another, per Idaho Education News.
The late plaintiff, as Idaho Education News noted, was a trans student who died by suicide in January, identified only in court filings as Jane Doe. Lawsuits against the bathroom ban were currently pending in the U.S. Court of Appeals for the Ninth Circuit and the U.S. District Court of Idaho.
Now in effect as of May 2025, the law bans students from using bathrooms and locker rooms that match their gender assigned at birth and also permits students to sue schools if they encounter a trans person in a public restroom or changing facility for a minimum fine of $5,000, per Boise State Public Radio.

A persons sex is natural at conception...It cannot be changed...
A persons physical appearance can be altered by surgery, the chromosomes XX and XY stay the same no matter what surgery or mental attitude a person has...
Biologically, a person is either female (XX) or male (XY)...PERIOD...

Yes, sometimes the mentally ill kill themselves, sometimes they murder others.
It was NOT “anit-trans” legislation; it was pro common sense and science legislation.
Schools have a solution at hand for “trans” persons experiencing emotional difficulty using restrooms designated for their biological gender; schools can designate single-use restrooms as available to students (most staff restrooms are single use). That is all they need to do.
Staff for physical education also have single use restrooms, which they can allow designated students to use.
There is nothing good about forcing “trans” kids and their phobias on normal kids in restrooms or gym locker and shower situations.
Meanwhile, what “trans” kids need most is not approval and acceptance of their errant mental obsession. Yes, they need compassion and sympathy, but most of all they need professional mental health services to help them stop the errant mental obsession trying to take a hold of their life. THAT is the “gender affirming” care they need - care that helps them affirm their biological gender.
Sex is determined at conception.
