New Court Filings Show Grand Jury Properly Voted On Indictment of Former FBI Head Comey

New court filings show that former FBI Director James Comey’s indictment on charges of obstructing justice and making false statements to Congress was properly voted on by members of the grand jury.

Lindsey Halligan, the interim U.S. Attorney had admitted to the trial judge on Wednesday that the full grand jury never saw the final version of the charges against Comey.

Comey’s defense team had seized upon that admission as a possible misstep which could doom the prosecution’s case, but filings from Halligan’s office later that same day appear to show that correct procedures were followed and that the charges remain legally valid.

On September 25, members of the grand jury voted on three counts against Comey, two for making false statements to Congress and one count of obstruction of justice.

However, the jury failed to return a majority vote on one of the false statements charges and only the two of the counts were returned.

The New York Post reports that the grand jury foreperson told US Magistrate Judge Lindsey Vaala, “It was the very first count that we did not agree on, and the Count Two and Three were then put in a different package, which we agreed on.”

The judge also had to negotiate a brief misunderstanding after the indictment was redrafted, asking the grand jury foreperson, So you voted on the one that has two counts?”

The jury foreperson answered, “Yes.”

Meanwhile, Halligan and Assistant US Attorneys Tyler Lemons and Gabriel Diaz wrote in Thursday’s filing that the transcript “confirms the Court’s recognition that the two-count true bill is the valid, operative indictment.”

Prosecutors appeared to slam the door on the hopes of Comey’s defenders, writing, “The complete record eliminates any doubt: The foreperson confirmed the vote. The Court acknowledged the vote. The Court docketed the two-count true bill as the operative indictment. Only Count One lacked concurrence; Counts Two and Three were true-billed by at least twelve jurors.”

Comey should be a key part of the Criminal Conspiracy case too. Also Judge Boasberg.

I think what the judge did to Lindsey Galligan was defamatory. She should sue him. He never should have spoken that way or made a ruling like that with knowing 100% that it was true. He is either incompetent or malicious and did it to smear get and prejudice the case. He needs to be removed from the bench.

I had to laugh...that defamation was nuthin' compared to the comments of some Freepers on this forum!

For someone who is not following along why did she say this:

I’m sure all of our know-it-all FReepers will be flooding this thread with their apologies for disparaging comments they posted about the prosecution team. Took them about five minutes to begin heaping their ignorant disdain on the U.S. attorney.

There IS some gross incompetence going on here. DOJ ADMITS one thing. Then later decides they were wrong. Apparently.

The fact that the jury did not approve one count is proof positive they reviewed and voted on all the counts in the bill, disapproving one and approving two. After doing so, there should be no requirement they had to vote again on the cleaned up bill, which containing only the original previously approved two counts.

The activist judge asked the attorney about something that is not required. The grand jury voted on three counts. They did not get a majority on the first count, but they did on the second and third counts. The official charge filing was rewritten to remove the first count and the jury foreperson agreed that this was how the grand jury voted.

There was no reason to vote again since they voted on each individual count already. This was just an activist judge and MSM reporting to protect Comey.

This has been amateur hour from the get-go....

There were two easy ways to rectify this, now just one.

The first, best way was simply to resubmit the indictment with just the two counts and have the GJ indict on that. That ship sailed.

The second is just to provide the grand jury transcripts, which the DOJ is oddly refusing to share.

FACT CHECK: At no time during yesterday’s hearing did US Attorney Halligan say that the entire grand jury didn’t see the 2 count indictment
