Former Alabama college instructor sues after she says she was fired for post on ‘wicked’ Charlie Kirk

A former educator at Auburn University and the University of Alabama has sued college leadership in federal court after she says she was fired for a post responding to the assassination of right-wing activist Charlie Kirk.

In her complaint against Auburn University, Candice Hale says that her firing violated her First Amendment rights.

“Candice Hale exercised her right to speak on matters of public concern, the death of Charlie Kirk, a political figure—expression that lies at the core of the First Amendment—and was subsequently terminated for doing so," the complaint reads.

“Such retaliation cuts to the heart of democratic principles, where open discourse and the free exchange of ideas are essential to the preservation of liberty and justice.”

On Sept. 11, one day after Kirk died after being shot while speaking at a campus event at Utah Valley University, Hale shared her thoughts in a post to Facebook.

“I do not mourn oppressors,” she wrote.

“I do not show them empathy. I don’t give a damn about evil racist, fascist, misogynist, homophobic, transphobic, xenophobic, mediocre white men who claim to be Christian individuals and then do everything Christ would not do on Earth.”

“I will not mourn the wicked,” the post continues.

“We are getting closer and closer to the real assignment.”

Yeah, even on my worst day, I’d still rate her a 2, but that’s only because I’ve never seen a 1.

Congress shall make no law....

Your employer, however, may have some ideas about your speech, and potential consequences thereof.

Idiot.

The First Amendment prohibits the government from censoring what you might want to say before you say it.

It does NOT make you immune to suffering consequences for what you’ve said after you’ve said it. If it did, we wouldn’t have libel and slander laws.

It will shock no one that she’s not a physics professor but an English Studies lecturer. Or was

And even her family thinks she’s nuts

Figures. “Hale was a lecturer of English at Auburn, teaching composition, world literature and African American literature.”

Her students hated her, too.

As a retired university professor, it is well known in academe that you can generally say what you want on social media but if you embarrass your employer, you will be fired. Tenure might slow the process but isn't necessarily protection from losing your position.

I assure you that if she wanted to build her resume to get her job back at the Univ. of Alabama, the best thing she could do is today, and it must happen before the end of today on the 3rd Saturday of October, is use that same social media to post anything she can horribly say, real or imagined, about former Tennessee coach Phil Fulmer. At Bama during this time of year, that's the best way to pay penance. LOL

Indeed. I wonder why any semi-intelligent law firm would take such a ridiculous case.

Your First Amendment right of free speech guarantees that you will not be taken to the gulag for expressing your opinions. It doesn’t guarantee that your employers has to tolerate you.

I think she was employed Auburn. They might hate Fulmer, too, but they hate Bama more, so I’m not sure it would help her.
