Sadly, it would not be hiring them if it didn't feel they were better trained for the job at a given price. If they are equally trained, but the H-1B will work for less, then the American worker needs to lower their wage expectations. You can't blame TCS for hiring the best workers at the best price in a free market. With the $100K penalty that's proposed, someone is going to end up paying the increased cost and that usually is the end customer...us.

This makes no sense, there is an endless supply of cheaper foreign labor that are willing to work for less than American workers. There are 1.5 BILLION people in Indi alone, so they have enough to displace all Americans many times over. The question is what kind of country do we want to live in, not subsidizing tech billionaires in Silicon Valley to buy bigger yachts.
