(Sep. 27, 2025) — Vattel’s legal treatise was mentioned in communications between John Jay and others during the revolution and founding and framing time period. Vattel’s legal treatise was a very important guiding light and legal reference to the Founders and Framers in the justifying the revolution, the founding of our nation, the writing and framing of our founding documents, and in the establishment of our new U.S. Federal Government’s “Common Law” via subsequent U.S. Supreme Court Decisions, especially regarding U.S. citizenship.
John Jay became the first Chief Justice of the U.S. Supreme Court. I have often wondered if the book that he has his left hand resting on in this well-known picture of him as the Chief Justice is Vattel’s legal treatise, “The Law of Nations of Principles of Natural Law“. From history we know that he rested many of his decisions regarding our new nation on the Principles of Natural Law, and specifically Vattel’s preeminent legal treatise on the Principles of Natural Law. It would be a worthy book befitting him to pose with, given his strong belief and support of the Laws of Nature and Natural Law, which were espoused and attested to as the legal basis for the revolution in the preamble of our nation’s Declaration of Independence. Jay later became widely hated because of the Jay Treaty with Great Britain, which had unfavorable terms for the US but averted war with the UK. When Congress passed a vote of appreciation to George Washington as his second term was coming to an end, the Congressman from Tennessee voted against it because of the Jay Treaty. His name was Andrew Jackson.
John Jay was a very dedicated follower of the Christ of the Bible, a descendant of the Huguents massacred 1572. He firmly believef and said that our nation was meant to be Christian nation.

First, did he swear allegiance to the law of nature or to the U.S. Constitution??? I suspect the latter. Next, his adoration of Emerich de Vattel is misplaced. While Vattel wrote a fine book on International Law, and on laws in France, this was not of any great import to American law, which was based on English common law. And even if it had been, Vattel recognized that England created citizens in a different fashion than France, stating:
Section 214: Finally, there are states, as, for instance, England, where the single circumstance of being born in the country naturalizes the children of a foreigner.

To recap, Commander Kerchner, has a lousy command of the facts. One could almost say Kerchner’s Grasp of Reality is sooo weak that he is unfit for command of the Vattel Birthers. One could, except for the fact that people who have a good grasp on Reality do not become two citizen-parent Birthers in the first place.
I picture Kerchner sitting in a chair, Queeg-like, sweating and rolling some ball-bearings around in his hand, claiming he didn’t cut his own tow line, that there was a duplicate key to the ward room icebox, and that it takes two citizen-parents to be a natural born citizen.

After reading that article, and considering Kerchner’s decades long descent into the Sea of Silliness, I have but one question for him - Did Vattel say the following, yes or no -
Section 214: Finally, there are states, as, for instance, England, where the single circumstance of being born in the country naturalizes the children of a foreigner.
