PENDLETON — An eastern Oregon educator is suing his employer, alleging an order to remove anti-trans children’s books from his desk violated his constitutional rights.
Education specialist Rod Theis filed the federal lawsuit in May against the InterMountain Education Service District. He claims the district ordered him to remove two children’s books — “He is He” and “She is She” — from his desk. Theis asserts the two books explain that every child should love and accept themselves as God intended.
Theis alleges the district violated his rights to free speech under the First Amendment and equal protection under the 14th Amendment because the restriction is overbroad, not content-neutral and expresses hostility toward his religious-based viewpoints.
“Our legal system is built on the truth that the government can’t silence a speaker just because it disapproves of what he says,” his attorney Tyson Langhofer said in a statement.

Clever writer.
They're 'common sense' books.
Beat me to it.
There is no such thing as “transgendered.”
This is a tough call. The teacher probably put those books on his desk as a way to start a reasonable discussion on the topic. Well, okay.
But if this teacher is allowed to keep those books on his desk, could a Muslim teacher keep the Koran on his desk? You know, for discussion purposes (aka, conversion purposes).
I would support having those books in the school library. Libraries should have books with lots of different points of view.
Having them on his desk (presumably in a classroom or his office if he has one) is harder to support. IMO those places should be neutral, so that any student could feel comfortable (or at least not challenged). Would I as a student feel comfortable if the teacher had a gay pride flag in his classroom or in his office? No. So keep those places neutral -- reasonable discussion can still take place.
BTW, whatever happened to reading, writing, and 'rithmetic?

Outrage about he and she?
I remember a while back, there was liberal Outrage at Mr. Rogers. There was a video from his show in which he said something about how girls will grow up to be women, and that boys watching his show will become men.
I know it’s triggering to the left. Mr. Rogers completely overlooks the possibility that there are Trans kids out there.
If they allow other teachers to keep books on their desk that are in support of LGBT stuff (Billy has 2 mommies or whatever), then they should allow this teacher to have his books on his desk. Otherwise, this is viewpoint discrimination.
Nothing tough about it. They rot will continue until it is stopped
I totally agree. Allow all personal-opinion books, or none of them.
But I don’t think that will stand up in court. And that’s because school boards are allowed to set the rules (discriminate) to a great extent. For example, they could put Marx’s writings in the school library, but forbid Hitler’s.
Even though both men caused equal amounts of damage to this world.
Nice find.

Just don’t let your babies grow up to be cowboys.
