“private corporations can do anything they want and are not bound by discrimination laws... unless they are publicly traded”

Wow you are way way off.

Private corporations and companies are subject to state, federal civil rights and anti discrimination laws if they:

• Employ people
• Sells goods or services
• Provides housing
• Is open to the public in any way

Applicable laws include:

• Title VII of the Civil Rights Act of 1964 (employment)
• Fair Housing Act (housing discrimination)
• Title II of the Civil Rights Act of 1964 (public accommodations)
• Americans with Disabilities Act (ADA)

Try opening a whites only motel and see what happens.

They could have gotten around all those laws by structuring themselves as a private club. Maybe they were looking for donations and figured this was the way to go about raising funds and attracting additional membership. Buy now they’ve opened themselves up to legal challenges.

You are correct about corporations.

I wonder if a trust would work?

I think there are charitable trusts that focus on helping blacks, Latinos, Jews, even women or gays.

Would a trust focused on helping whites (however they choose to define that) stand up to legal challenges?
