MIDDLEBURG. Fla. — A Middleburg family is begging for help after they claim ICE officials are threatening the husband, who is an Indian national, with immediate deportation and criminal charges.
Tapan came to America on a J-1 visa in 2011.
It expired in 2013.
Last year, he married Ashley and they filed an I-130 marriage petition in hopes of regaining his legal status.
ICE officials arrived at their home Thursday morning demanding Tapan come outside to be taken into ICE custody for deportation.
He did not.
The family claims ICE officials told them they’d return with a warrant and charge Tapan with failure to comply with supervised release.
“And at that point, they can kick our door down and come in in front of my children and take my husband in front of them,” said Ashley. “My husband may not be a legal American citizen, but is a human being and he has rights.”

Nothing as rights trampled and businesses ruined. Tears and gnashing of teeth when an invader gets caught.

Most Americans do not know the difference is the only reason I ask. The consulate deals with issues for it's citizens. The embassy deals with issues between governments.
If you personally need help over seas the embassy is pretty much useless unless you are a government official.
And you probably know this now but whatever advice an attorney gives you, research it. Lawyers are like every other profession, some of them are ok but most are not that great. And immigration is a very murky area.
One alternative you might have is picking a third country where you can be together while the paperwork goes through. Neither of you could work except remotely, not sure if that is an issue, but you will be in the same location. Which would be a lot less stressful for both of you.
Maybe the Philippines.

I can say that the embassy in Tokyo was terrible, like a subsection of the Deep State.
